What <br />about a fall from the dock or a drowning? <br />There is also reference made to the boat landing/take off <br />area for water skiing (pg IX-11.). Considering the direct- <br />Tonal travel required by the WSUM ordinance,"the fishing <br />dock area, small craft launch area, and the water ski <br />and power boat beach area conflict with eachother.- <br />Parking for cars with car top cariers indicates encourage- <br />ment of a previously minor activity such as wind surfing <br />and sailboarding or sailboating beyond what had been <br />previously seen on this lake. Again, a degree of lia- <br />bility exists wherin the park will have created and en- <br />couraged an unsafe situation by design. <br />• To further complicate matters, a condo is being construct- <br />ed on the SW corner of Long Lake. It is natural to assume <br />that some type of boating activity can be .expected from <br />-the 25 units in this complex. It is out. of the jurist- <br />diction of the park, and therefore,., out of their control. <br />They are a very real entity to the total picture. <br />The authors of the Master Plan are aware of the possib- <br />lity of .boating mishaps (pg X-4E). The frequency of oc- <br />curance and the severity of same can only be determined <br />after the fact once the park is completed. The statement <br />on (pg VL-18) indicating that a long lake will have less <br />high speed recreation than a round lake is without foun- <br />dation. Rather, it is a poor effort to play down a po- <br />tentially serious situation. <br />Correspondence from the DNR to New Brighton on 03/26/82. <br />• indicates the. average elevation of the lake is 866.2. The <br />WSUM guidelines prohibits any boat traffic in excess of <br />'moo wake' speed if-the leve].~of the lake exceeds 866.22 <br />(19-31).
