Easement A reement for utilit trail and road cras <br />nnesota ransfer a wa Cam an r~ t-o -wa in <br />Home Gas and Walburn Ltd, property <br />The County Board at its February 25 meeting approved 1:he <br />easement agreement with the Minnesota Transfer Railway Company. <br />Staff met with representatives of Texgas on February 6 to <br />discuss the implications of the proposed easement. At the <br />conclusion of the meeting it appeared that the Texgas repre- <br />sentatives supported the proposed easement acquisition, in <br />fact, they suggested that the County consider fee title <br />acquisition of the entire 1.8 acre parcel. Staff is currently <br />awaiting approval; of the easement agreement by the Texgas <br />Board of Directors. <br />The County Attorney's office has been negotiating with the <br />Attorney for Walborn ttd., and subsequently has :agreed :to <br />three preconditions. A letter from the County Attorney's <br />office (2-11-85) requested that the attorney far Walborn <br />Ltd. redraft the initial easement agreement to incorporate <br />language relative to the three preconditions. <br />s. Pipeline Site Intrusion (Williams Pipeline Co.) <br />The Public Works Committee at its February 11 meeting rejected <br />the amended draft agreement and directed the staff to focus <br />an other alternatives. Some Committee members were adamant <br />about not providing a permanent easement .far the pipeline on <br />park property (as required by the draft agreement) due to risk <br />of liability associated with potential pipeline leaks. <br />The Public Works Committee at its February 25 meeting approved <br />an alternative recommended by staff which proposed that: <br />
