Chapter 7 ~I'Y1p~Et'Y1e11tC~t1011 169 <br />Commercial and Industrial Districts <br />New Brighton has five commercial and three industrial <br />districts. Commercial districts include Limited Business <br />(office), Neighborhood Business, General Business, <br />Downtown Business, and an Office Development Dis- <br />trict. Industrial districts include Light Industrial, Heavy <br />Industrial and Restricted Industrial, a district border- <br />ing residential and open space areas. The commercial <br />and•industrial districts do not allow residential uses <br />except mobile home parks by special use permit. Per- <br />formance standards are specified for commercial and <br />,; industrial districts. <br />$-. Subdivision Regulations New Brighton has had regulations governing land subdivi- <br />sion for a number of years. Points of particular note in the <br />' regulations are a requirement for conformity of subdivisions <br />with the Zoning Code and comprehensive plan and a require- <br />ment that natural features, such as woodlands and wetlands' <br />be taken into account in subdivision design. <br />C. Environmental Regulations The City of New Brighton has a number of specific ordi- <br />nances which will be used to implement various aspects of <br />this plan. The major ordinances are discussed below. Addi- <br />tional implementation measures are discussed in each, section <br />of the plan. <br />Sewer and Septic Tank Regulations <br />The City's sewer ordinance has a number of provisions <br />among which is a requirement that any sewer improve- <br />meet be consistent with the comprehensive sewer plan <br />approved by the Wastewater Control C~ramission. The <br />ordinance prohibits any sewer discharge to any natural <br />outlet. Connection to the municipal sewer system is <br />required when a sewer line is within 75 feet of the <br />property. This requirement applies to virtually every <br />lot in the City. All new subdivisions are sewered at the <br />time of construction. <br />If any of the handful of private systems malfunctions, <br />correction is enforced under the City's nuisance ordi- <br />n~nce, Connection to the City sewer system or recon- <br />structlan accor3ing to Minnesota Department of Health <br />standards is required. The City will adapt Minnesota <br />Department of Health Regulation WPC-40 to govern <br />r~ septic systems, <br />a <br />Wetlands and Water Bodies Protection <br />The City has an ordinance which prohibits filling or other. <br />alteration of wetlands without a special permit. Appli- <br />cants for such permits are also referred to the Rice Creek. <br />Watershed District to obtain Watershed District approval. <br />Permits approved by the City are routinely conditioned <br />an approval of the Rice Creek Watershed District.
