Batty <br />Mr. Maurice Anderson <br />Dix'ector of Parks & Recreation <br />City of New Brighton <br />1975 Si1vPr Lake Road <br />New Brighton, Minnesota 55.112 <br />Re: Boat Launch Facility at Long Lake Park <br />Dear Mr. Anderson: <br />Yau have asked for my opinion on the question <br />whether the joint powers agreement relating to maintenance <br />and operation of Lang Lake/Rush Lake Regional Park <br />gives the City the authority to open a boat launch <br />facility adjacent to the swimming beach facility an the <br />south end of Long Lake. The property in question, <br />including the land currently being used by the City for <br />a swimming beach, has been deeded to the County. The <br />joint powers agreement provides that the City shall <br />continue to conduct a public beach operation at Long <br />Lake Park; however, it does not give the City any <br />further rights to the use of the property. Therefore, <br />in my opinion, it would be necessary to secure the <br />ccansent and approval of Ramsey County prior to opening <br />and operating a boat launch facility on the lake. <br />Very truly yours, <br /> <br />Charles L.
