<br />"" <br /> <br />~ <br /> <br />.. <br /> <br />WHEREAS, Long Lake Road between County Road D and Old Highway 8 will <br /> <br />serve as a right turn lane for vehicles traveling west on County Road D, turning and <br /> <br />traveling north on Old Highway 8; and <br /> <br />WHEREAS, the Minnesota Department of Transportation has determined storm <br /> <br />sewer cost participation based on contributing areas and existing outfall line credits; and <br /> <br />WHEREAS, the City and County will participate in the cost, operation and <br /> <br />maintenance of said project as herein set forth. <br /> <br />NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AS FOLLOWS: <br /> <br />1. The County or its agent shall prepare the necessary plans, specifications, <br /> <br />proposals, take bids and recommend the Commissioner of Transportation award a contract <br /> <br />for the construction of this project, S.P. 62-619-04; the County shall perform the <br /> <br />construction inspection. <br /> <br />2. The County shall acquire additional permanent right of way and temporary <br /> <br />easements required for the construction of this project in accordance with the plans <br /> <br />and specifications. The County shall pay for all additional rights of way in the County. <br /> <br />3. All County Road D rights of way and temporary easements in the County <br />will be in the name of the County, and parking and other regulations will be controlled <br /> <br />by the County. <br /> <br />4. Any utilities or facilities modified or added to those provisions presently made <br /> <br />in the plans and specifications may be incorporated in the construction contract by <br /> <br />supplemental agreement and shall be paid for by the City as specified in the supplemental <br /> <br />agreement. <br /> <br />5. The City shall not assess or otherwise recover any portion of its costs for <br /> <br />this project through levy on County-owned property. <br /> <br />6. The Minnesota Department of Transportation has determined that a portion <br /> <br />of the total project storm sewer cost is not eligible for reimbursement from federal <br /> <br />or state aid funds. That portion attributable to the City runoff is estimated as 8.73 <br />percent of the total storm sewer cost. The City shall pay to the County the cost of <br /> <br />the storm sewer system attributable to the City not eligible for fund reimbursement. <br /> <br />Estimated City costs, based on the engineer's estimate, are attached as Exhibit A. <br /> <br />7. Upon completion of the project, under the terms of this agreement and <br /> <br />separate Ramsey County Agreement No. 84017 with the City of Roseville, the County <br /> <br />will maintain the storm sewer catch basins and leads and the City will maintain the <br /> <br />storm sewer trunk lines in the City. <br /> <br />84016 <br />2 <br />
