The City shall pay to the County a portion of the cost of concrete curb and <br /> <br />gutters constructed within the City except for medians and replacement of existing <br /> <br />concrete curb and gutters. The concrete curb and gutters to be paid for by the City <br />are estimated to be eligible for 76.74 percent federal aid funds and the City shall pay <br />75 percent of the remaining 23.26 percent as estimated in aforesaid attached Exhibit A. <br />9. The City shall pay to the County 100 percent of the cost of the detached <br />path in the City except the 76.74 percent of the cost estimated to be eligible for <br /> <br />federal aid funds as estimated in aforesaid attached Exhibit A. <br /> <br />10. Upon completion of the project the City and County shall jointly inspect the <br /> <br />path and the City shall approve, by letter, the construction in conformance with the <br /> <br />plans and specifications. The City will then assume responsibility for the path and the <br /> <br />City shall own, maintain and operate the path. <br /> <br />11. The City shall pay to the County 100 percent of the water utility improvements <br /> <br />identified in the plan a." Item 0504.607, 6" Valve Box and Assembly as estimated in <br /> <br />aforesaid Exhibit A. <br /> <br />12. Upon award of contract, the County will assume ownership, maintenance and <br /> <br />operation of that portion of Long Lake Road between County Road D and Old Highway 8. <br />13. The City shall pay eight percent (896) of its share of the construction cost <br /> <br />prior to any federal participation, as determined by the contract as awarded, to the <br /> <br />County as a preliminary engineering fee. This fee shall be due upon award of the <br /> <br />construction contract. See aforesaid Exhibit A. <br /> <br />14. The City shall pay five percent (5%) of its share of the construction cost <br /> <br />prior to any federal participation, as determined by the final contract amounts to the <br /> <br />County as a construction engineering fee. This fee shall be due upon notification to <br /> <br />the City of the final amounts paid to the contractor. See aforesaid Exhibit A. <br /> <br />15. Upon request by the City for reimbursement of any eligible funds through its <br /> <br />municipal state aid system funds the County shall provide such documentation as may <br />be available and in the interest of the City. <br /> <br />16. The City will pay 100 percent of its share of the estimated cost to the <br /> <br />Treasurer of Ramsey County, Minnesota, prior to award of contract and the contractor <br /> <br />shall then be paid by the Minnesota Department of Transportation. All monies paid by <br /> <br />the City and not expended on the project will be returned within a reasonable time, not <br />to exceed two (2) years from deposit, or thirty (30) days from the time of final payment <br /> <br />on the project, whichever shall occur first. <br /> <br />84016 <br />3 <br />
