<br />~'-H ' <br /> <br />, ' <br />: <br /> <br />.",.. ,~ <br /> <br />". <br /> <br />RESOLUTION NO 8J-133 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />I CITY OF NEW BRIGHTON <br />I. <br />I, <br />III RESOLUTION GRANTING THE MENGELKOCH COMPANY AN OFFENSIVE TRADES <br />I LICENSE AND AFFIXING CERTAIN CONDITIONS OF OPERATION <br /> <br />I WHEREAS, the City of New Brighton is responsible for the <br />II general safety, health. welfare and well-being of its residents <br />Ii and has established codes to aid in carrying out this <br />I responsibility; and <br /> <br />WHEREAS, City Code Chapter 24 entitled Sewer Department <br />Regulations and Chapter 15. Article VII. entitled Offensive. <br />I Dangerous Trades. and Metropolitan Sewer Board Rules and <br />I Regulations for the Metropolitan Disposal System and the <br />I Minnesota Pollution Control Agency Regulations all apply to <br />I the operation of the Mengelkoch Company as a rendering business; <br />. and <br /> <br />I WHEREAS, the City is aware and has been informed that certain <br />I deficiencies in the operation of the Mengelkoch Company have <br />I! occurred in the past with respect to these codes, rules, <br />regulations and standards; and <br />. <br />II WHEREAS, the deficiencies which previously existed in regard <br />11 to disposal of sewage have, in the past. affected the safety, <br />health, welfare and well-being of the City's residents in that <br />such deficiencies cause plugging of the sanitary sewer and lift <br />II station, interference with sanitary sewer service to others, <br />I dumping of raw sewage on the open ground. and emission of <br />! offenslve odors in the neighborhood; and <br /> <br />II'WHEREAS, on January 28, 1983, a stack emission test. in <br />, conformance with American Society for Testing Materials Method <br />i (ASTM) D-1397-57, was performed on the emission from the <br />stack of the Mengelkoch Company plant facilities at l19-l7th <br />Street NE and such test indicated an average odor level of 84.0 <br />odor units per cubic foot, which is below the limit of 150 odor <br />units allowed by APC-9. Further. that the test indicated a total <br />emission rate of 1.290,000 odor units per minute which is not <br />within the limit of one million odor units per minute allowed <br />by A P C- 9; and <br /> <br />I <br />II <br />! <br />p <br />I' <br />I! <br />,I <br />I; <br />I! (after resolving the problem) <br />a new test indicated an average odor level of 21.0 odor units per <br />cubic foot and a total emission rate of 432,800 odor units per <br />minute. <br /> <br />WHEREAS. on August 19. 1983. (after resolving the problem) <br />a new test indicated an average odor level of 12.4 odor units <br />per cubic foot and a total emission rate of 284,100 odor units pe <br />minute. <br />
