't , I' -2- NOW THEREFORE BE IT RESOLVED, that the Offensive Trades License of the Mengelkoch Company for the premises at 119-14th Street NE be granted under the following conditions: ;: Ii I ! 1. All d 0 0 rs and win d 0 w s s h all b eke p t c 1 0 sed d u r i n g periods of operation so that all rendering plant air will be processed through a scrubber, except during periods of loading and unloading when loading doors may be open but these periods shall be kept to a minimum. 2. The Mengelkoch Company shall continue to perform all obligations required of it by its agreement with the City of New Brighton dated January 25, 1977, and as amended by a subsequent agreement dated December 12, 1978. 3. That any plugging or impairment of the operation of the City sewer system with grease will be considered ! prima facia evidence that Section 24-8 of the City l' '. Code, Section 15-147 of the City Code, Article V, !! Section 5-4A of the Rules and Regulations for the 11: Metropol itan Sewer Disposal System have been and are i being violated and that the right of the rendering II ,I plant to use the City sewer system is thereby immediately !i suspended. The amount of grease discharged into the i' City sewer system shall be 100 mg. per liter or less. Ii If the City sanitary sewer system or lift station wet Ii well becomes plugged as a result of the operations at II the rendering plants, the cost of cleaning shall be ;; paid by the rendering plants making use of that part 'I of the sewer system that has become plugged. 1"1' 4. That the Mengelkoch Company be appraised that the City of New Brighton will continue to work with the Minnesota Ii Poll ution Control Agency and the Metropol itan Sewer !. Board to assure that all applicable rules, regulations 1\ and codes are compl ied with. I: 5. That not less than two, and at the City's discretion, d up to four stack tests are to be made each year and i that frequent inspections be made by the City II! Sanitarian to make sure the Mengelkoch Company is Ii complying with the City's requirements. II BE IT FURTHER RESOLVED, that violation of, or failure to Ii comply with, any conditions of this Offensive Trades License Ii shall be cause for suspension or revocation of this 1 icense, II and that such suspension or revocation shall be considered by Ii the City Council.
