<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />February 11, 1986 <br /> <br />Mark Jeppson asked the city what has become of the Zack Johnson <br />study, and expressed concern about the safety of the swail area <br />as it is adjacent to the apartment building and a lot of child- <br />ren; Briggs indicated the city's ordinance requires the swail to <br />be fenced, and that the swail would be 18 inches deep at its max- <br />imum for one hour and they would make sure it is safe, noting the <br />pond is in the immediate vicinity and would be much more attract- <br />ive to the children in the area. <br /> <br />Benke noted that Meadow Wood Park has a similar storage plan for <br />the northeastern corner and, as he believed this particular swail <br />to be much less of a problem, asked Proper to react; Proper indi- <br />cated the slope on the proposed swail would be 3-to-l or less and <br />is a generally safe situation. <br /> <br />Winkels reviewed the history of a request for a six-story build- <br />ing and the possible impacts; a study had been conducted by Zack <br />Johnson. Although Johnson is no longer with the firm, Winkels <br />recalled that Johnson felt six-stories was too much for that <br />piece of property but that four stories would be appropriate. <br /> <br />Briggs indicated Johnson had related the same information to him; <br />Schmidt also recalled that four stories would be adequate for the <br />site. <br /> <br />Eva Jeppson questioned if Mr. Harstad had applied for a variance <br />at that time; Benke stated there never was an application through <br />the Planning Commission process. <br /> <br />Sinda stated he was involved when the question of a six-story <br />building arose; the use of a consultant and when it might be <br />appropriate was brought to council and discussed, at which time <br />it was indicated it was worthwhile getting unbiased opinions. <br /> <br />Benke asked if the contract with Mr. Johnson was an administra- <br />tive contract within Sinda's authority; Sinda responded affirma- <br />tively. <br /> <br />Eva Jeppson asked if the 7% of the land for the building included <br />land from the church; Briggs responded affirmatively and noted <br />that without the church, the building would be 10% of the land. <br /> <br />Benke asked if the developer would pursue the purchase of the <br />church property if the variance was not granted; Briggs respond- <br />ed they would not purchase the land but would construct a differ- <br />ent building. <br /> <br />Brad Martinson, attorney for the neighbors, presented council <br />with letters from: Reverend Stanley O.
