<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />September 10, 1985 <br /> <br />Fuhr asked if that action set a precedent for every city in the <br />state with regard to what happens in this City; Benke responded <br />that the courts are full of cases regarding similar actions. <br /> <br />Fuhr asked City Attorney if it was not possible to consider a <br />Right of Eminant Domain as it regards not only the asphalt company <br />but any other industrial area that so closely adjoins that park; <br />asked if the City has friends in the Ramsey County Park System <br />and other citizens that are able and willing to step forward to <br />pursue this type of situation. Private property rights, social <br />rights. and social welfare of the community. city. state. and <br />national are also in this balance. <br /> <br />Harcus stated we are working on developing the whole area but <br />there are some environmental problems that are delaying the plans. <br /> <br />Fuhr asked if the second site Bury was considering was within the <br />city's confines; Harcus responded affirmatively; Blomquist stated <br />the particular site is just north of the rendering plant on 14th <br />Street next to the freeway; Harcus stated Bury's primary customer <br />is the rendering plant. <br /> <br />Skrebes thanked the council for its faith. supoort and assist- <br />ance in having him reappointed to the Regiona~' Transit Board. <br />Skrebes believes there was a misconception of the whole garbage <br />burning disposal issue and thanked the City Attorney for his time <br />to explain the issue and hopes the press media will also get the <br />word out. <br /> <br />Motion by Benke. seconded by Harcus. to REFER THE PETITION TO THE <br />ENVIRONMENTAL QUALITY COMMISSION. ASKING THEM TO PREPARE A SUMMARY <br />REPORT ON THE WHOLE AREA OF RDF AND THE ADMINISTRATION OF GARBAGE <br />TECHNOLOGY AND TO INVITE IN THE APPROPRIATE EXPERTS AND HOST A <br />COMMUNITY INFORMATION MEETING. <br /> <br />Harcus recalled that Bury had made presentations to the Chamber of <br />Commerce. the New Brighton Rotary Club. and the City Council and <br />Harcus hear nothing negative from those presentations. <br /> <br />Benke stated that. if we are going to have the plant. he would <br />rather have it near the freeway rather than near the park. <br /> <br />4 Ayes ~ 0 Nayes. Motion Carried <br /> <br />Bob Pierce and Dick Gilyard. Lindberg Pierce. Inc.. architects for <br />the project. reviewed the latest sketches and drawings. Questions <br />were raised concerning relocating/moving staff during construction; <br />Pierce indicated therewould be a pre~construction conference with <br />the lowest bidder and stated that this project will require a full- <br />time superintendent and one contractor will be selected. <br /> <br />Motion by Harcus, seconded by Blomquist. to APPROVE PLANS AND <br />SPECIFICATIONS AND AUTHORIZE ADVERTISEMENT FOR BIDS ON FRIDAY. <br />OCTOBER 4, 1985. <br /> <br />4 Ayes - 0 Nayes.
