<br />, <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />August 26, 1986 <br /> <br />Council Business, continued <br /> <br />Locke reviewed staff report regarding the condemnation <br />proceedings on property in Tax Increment Finance District #6, <br />stating it is timely to take steps to move on the action. <br /> <br />Williams stated it appears that Mr. Hedlund agrees with the <br />procedure; Locke responded affirmatively. <br /> <br />Motion by Williams, seconded by Brandt, to WAIVE THE READING AND <br />ADOPT A RESOLUTION AUTHORIZING CONDEMNATION PROCEEDINGS ON LOTS <br />1 AND 2 OF BLOCK 1, LOT 1 OF BLOCK 2, AND LOT 1 OF BLOCK 3 OF <br />LEIER ESTATES WITH TAX INCREMENT FINANCE DISTRICT #6. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />With regard to a building permit for a single family home in an <br />industrial zoning, Locke stated the city.s building inspector <br />found that a home on Chenoweth's property was being substantially <br />remodeled and expanded without a building permit. <br /> <br />Schmidt noted the staff analysis indicates this is not a small <br />add-on kind of project or fix-it up project, it's a $60,000 <br />remodeling project; Locke indicated that is the inspector's <br />estimate. <br /> <br />Schmidt stated this is a major precedent in creating an after- <br />the-fact approval for an addition or remodeling expansion which <br />follows on the heels of approvals that were given when the fire <br />occured and for the greenhouse additions, and does not understand <br />how this could not have, or should not have, been addressed at <br />the time those approvals were requested and granted. At this <br />point, Schmidt stated he would not be in favor of granting a <br />building permit but noted the alternative would be to tear down <br />the addition, thus putting both the staff and council in a diffi- <br />cult situation. <br /> <br />Benke stated that, in checking with other sources, the presence <br />of such a residence on a greenhouse property is not unique so <br />that it would not be improper for this council to treat it in <br />that vein; however, Benke agreed that the timing of the item is <br />another matter and suspects the applicants are embarrassed by <br />the whole process, but that does not relief us of the fact that <br />there has been a substantial amount of work done without a <br />permit. <br /> <br />Benke asked if an inspection indicates everything is in confor- <br />mance with building codes; Locke indicated there are things the <br />inspector has not been able to see because of the extensive <br />remodeling that has already been accomplished, and that would <br />have to be worked out if they were granted a building permit. <br />Locke further indicated the city, at this point, has no suspicion <br />that anything has been improperly constructed. <br /> <br />Page Nine <br /> <br />Condemnation: TIF Di <br />strict #6 <br />Report 86-196 <br />Resolution 86-86 <br />
