<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Mi nutes <br />May 28, 1985 <br /> <br />Motion by Janecek, seconded by Harcus, to WAIVE THE READING AND <br />ADOPT A RESOLUTION MAKING FINDINGS OF FACT AND APPROVING NC-69 <br />SUBJECT TO THE FOLLOWING CONDITIONS: <br /> <br />1, THAT THE DRIVEWAYS BE ASPHALTED UP TO THE FRONT BUILDING <br />SETBACK, <br />2, THAT FILL PLACED ON THE SITE BY THE APPLICANT BE REMOVED <br />BY OCTOBER 1, 1985, TO MEET THE REQUIREMENTS OF RICE CREEK <br />WATERSHED DISTRICT AND THE CITY ENGINEER. AND <br />3. THAT ALL SITE WORK AND PAINTING OF THE BUILDING BE COMPLETED <br />BY OCTOBER 1, 1985. <br /> <br />4 Ayes - 0 Nayes, Motion Carried <br /> <br />Kreuger reviewed staff report concerning a request for a non- <br />conforming use permit and site plan approval to construct an <br />addition to a building on a site with existing Type IV non- <br />conformities; stated the Planning Commission did not get the <br />the required votes to approve the request; and noted that Dave <br />Miller, E-Z Stop, was present to answer questions, <br /> <br />Miller distributed and reviewed the revised site plan, <br /> <br />Blomquist noted they had done an excellent job of incorporating <br />the concerns of the Planning Commission and believes all con- <br />cerns are in the revised plan, <br /> <br />Harcus appreciated E-Z Stop's addressing neighborhood concerns, <br /> <br />Janecek asked staff how much E-Z Stop could do without council <br />approval, <br /> <br />Kreuger explained they could expand the inside of the building <br />without council approval; they are asking for five feet beyond <br />the carport, <br /> <br />Kreuger clarified that "restaurant" in the Planning Commission <br />minutes should be "restroom", and that a "75 foot landscape <br />buffer" should be a "9 foot landscape buffer," <br /> <br />Motion by Blomquist, seconded by Janecek, to WAIVE THE READING <br />AND ADOPT A RESOLUTION MAKING FINDINGS OF FACT AND APPROVING <br />NC-68 SUBJECT TO THE FOLLOWING CONDITIONS: <br /> <br />1, APPROVAL OF LP-178 AND <br />2. CONFORMANCE WITH SITE AND BUILDING PLANS AS SIGNED AND <br />DATED BY THE APPLICANT AND THE CITY PLANNER; and <br /> <br />TO RECOMMEND APPROVAL OF LP-178 SUBJECT TO THE FOLLOWING <br />CONDITlONS; <br /> <br />1.
