<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Mi nutes <br />May 28, 1985 <br /> <br />WAIVE THE READING AND ADOPT A RESOLUTION MAKING FINDINGS OF FACT <br />AND APPROVING VN-242, SUBJECT TO APPROVAL OF LP-169; WAIVE THE <br />READING AND ADOPT A RESOLUTION MAKING FINDINGS OF FACT AND APPROV- <br />ING SP-122, SUBJECT TO THE FOLLOWING CONDITIONS: <br /> <br />1, THAT ALL WALL SIGNS FACING A PUBLIC STREET BE OF INDIVIDUAL <br />LETTERS OF THE SAME SIZE, COLOR, AND LETTERING TYPE, AND <br />2, THAT THE GROUND SIGN BE MADE OF BURNISHED BLOCK TO MATCH THE <br />PROPOSED BUILDING AND THAT THE BUILDING NAME BE IN SEPARATE <br />ATTACHED LETTERS; AND TO <br /> <br />SET A PUBLIC HEARING FOR JUNE 11, 1985, TO CONSIDER A SUBDIVISION <br />OF CERTAIN PROPERTY IN NEW BRIGHTON. <br /> <br />Benke asked if there has been a response to the letter of May 21, <br />1985, to Mr, Willmus, <br /> <br />Kreuger indicated she had met with Mr, Willmus; has set up a meet- <br />ing with Armstrong Rigging to clean up what has turned into a <br />construction yard; and has advised Willmus (who has since been <br />working with Winkels) that the City sees Armstrong Rigging as a <br />perfect entryway into an overall industrial development. Kreuger <br />concluded that Willmus feels the city is taking a positive action <br />in addressing his issues, <br /> <br />4 Ayes - 0 Nayes, Motion Carried <br /> <br />Kreuger reviewed staff report concerning a request for a nOn- <br />conforming use permit to resume use of a site, which has had a <br />discontinued use in excess of six months, with Type IV non- <br />confonmities, noting that the applicant has proposed to address <br />all existing nonconformities. Kreuger felt the overwhelming <br />concern is the fill which has been placed in the rear of the <br />lot along Jones Lake and noted the Planning Commission has <br />recommended approval of the nonconforming use permit with <br />conditions which do include the fill. Kreuger indicated that <br />Tim McCormick was present to answer questions. <br /> <br />With regard to the proposed resolution, Blomquist suggested <br />replacing "if necessary" (Item 2 of Be it Further Resolved) with <br />a specific date, perhaps October 1, 1985, to conform with the <br />other requirements stated in the resolution, <br /> <br />McCormick stated he has met with Rice Creek Watershed Dsitrict <br />on the fill situation, There seems to be a discrepancy whether <br />or not there is any fill in the flood plain, He has agreed to <br />remove any fill if necessary, <br /> <br />Proper stated he had talked to Rice Creek Watershed District and <br />didn't feel there was any discrepancy, stating the fill was a <br />considerable distance into the flood plain; and felt a meeting <br />of AGC, Rice Creek Watershed District, the surveyor, and himself <br />would be helpful, <br /> <br />Page Nine <br /> <br />NC-69 - ACG, INC, <br />Report 85-151 <br /> <br />Resolution 85-54 <br />
