I I I Council Mi nutes May 28, 1985 WAIVE THE READING AND ADOPT A RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VN-242, SUBJECT TO APPROVAL OF LP-169; WAIVE THE READING AND ADOPT A RESOLUTION MAKING FINDINGS OF FACT AND APPROV- ING SP-122, SUBJECT TO THE FOLLOWING CONDITIONS: 1, THAT ALL WALL SIGNS FACING A PUBLIC STREET BE OF INDIVIDUAL LETTERS OF THE SAME SIZE, COLOR, AND LETTERING TYPE, AND 2, THAT THE GROUND SIGN BE MADE OF BURNISHED BLOCK TO MATCH THE PROPOSED BUILDING AND THAT THE BUILDING NAME BE IN SEPARATE ATTACHED LETTERS; AND TO SET A PUBLIC HEARING FOR JUNE 11, 1985, TO CONSIDER A SUBDIVISION OF CERTAIN PROPERTY IN NEW BRIGHTON. Benke asked if there has been a response to the letter of May 21, 1985, to Mr, Willmus, Kreuger indicated she had met with Mr, Willmus; has set up a meet- ing with Armstrong Rigging to clean up what has turned into a construction yard; and has advised Willmus (who has since been working with Winkels) that the City sees Armstrong Rigging as a perfect entryway into an overall industrial development. Kreuger concluded that Willmus feels the city is taking a positive action in addressing his issues, 4 Ayes - 0 Nayes, Motion Carried Kreuger reviewed staff report concerning a request for a nOn- conforming use permit to resume use of a site, which has had a discontinued use in excess of six months, with Type IV non- confonmities, noting that the applicant has proposed to address all existing nonconformities. Kreuger felt the overwhelming concern is the fill which has been placed in the rear of the lot along Jones Lake and noted the Planning Commission has recommended approval of the nonconforming use permit with conditions which do include the fill. Kreuger indicated that Tim McCormick was present to answer questions. With regard to the proposed resolution, Blomquist suggested replacing "if necessary" (Item 2 of Be it Further Resolved) with a specific date, perhaps October 1, 1985, to conform with the other requirements stated in the resolution, McCormick stated he has met with Rice Creek Watershed Dsitrict on the fill situation, There seems to be a discrepancy whether or not there is any fill in the flood plain, He has agreed to remove any fill if necessary, Proper stated he had talked to Rice Creek Watershed District and didn't feel there was any discrepancy, stating the fill was a considerable distance into the flood plain; and felt a meeting of AGC, Rice Creek Watershed District, the surveyor, and himself would be helpful, Page Nine NC-69 - ACG, INC, Report 85-151 Resolution 85-54
