<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Minutes <br />January 8, 1985 <br /> <br />City Attorney stated that that would not be uncommon and <br />that it could be clarified before a swap; would exchange <br />abstracts for clear title. <br /> <br />Schmidt stated that, in terms of the utilization value/ <br />economic value of the ditch, he still believes there remains <br />the serious question of the value of the property if the <br />city engaged in the swap. Beyond that is the issue of <br />whether the city would engage in the swap; whether a <br />building permit could ever be given by packaging the land <br />as proposed; sees very little utilization value for the <br />city to receive the ditch; we should table or deny. <br /> <br />Motion by Schmidt, seconded by Benke, to DENY THE APPLI- <br />CANT'S REQUEST FOR THE TRADE OF THE LAND. <br /> <br />Benke stated he was not yet convinced that the city could <br />create a buildable lot and, if in fact we did,we would be <br />creating a need for a variance and didn't feel that would <br />be to the city's advantage; didn't feel houses should be <br />crowded up next to the wellhouse. <br /> <br />Janecek stated she would vote to deny the swap as she <br />could not see any real advantage to the City, even if we <br />negotiated price to gain some monetary advantage; wants <br />to make sure the trees remain. <br /> <br />Blomquist feels there is an advantage to the city as we <br />would be formalizing a current use; but is not ready to <br />approve the land swap because there are still questions <br />to be answered. <br /> <br />Harcus agreed with Blomquist. <br /> <br />Benke stated if, in fact, when the floodplain ordinance <br />is adopted, there is a buildable lot on this site we <br />could reconsider. <br /> <br />3 Ayes - 2 Nayes (Harcus, Blomquist), Motion Carried <br /> <br />Benke asked if there would be interest to pursue the <br />question of acquiring the westerly portion in the absence <br />of an agreement for the eastern part of the area. <br /> <br />Motion by Blomquist, seconded by Janecek, to DIRECT STAFF <br />TO INVESTIGATE THE ACQUISITION OF THE WESTERLY PORTION OF <br />LAND AND REPORT BACK TO THE COUNCIL. <br /> <br />3 Ayes - 2 Nayes (Harcus, Schmidt), Motion Carried <br /> <br />Page Eleven <br />
