<br />Council Minutes <br />March 26, 1985 <br /> <br />I <br /> <br />Mrs. Barbara Burkheimer, 909 Tenth Street N.W., expressed <br />concern about the delay of the project noting that had <br />the project started on the south side of Tenth Street, as <br />originally planned, it would be well under way by this time. <br /> <br />Schmidt noted that in thirty days this project will be <br />approved or disapproved and that there will be no extension <br />beyond that thirty days. Schmidt reiterated that the City <br />would not acquire any land until it had a guarantee (Letter <br />of Credit) from the developer; the City is giving the <br />developer another thirty days to present the City with that <br />Letter of Credit; it would be irresponsible for the City to <br />approve anything this evening without having that Letter of <br />Credit in place; and the City has not done anything to <br />delay this project, it had been continued at the developer's <br />request. <br /> <br />Mrs. Burkheimer stated she appreciated the comments. <br /> <br />Motion by Blomquist. seconded by Harcus, to CONTINUE THE <br />WATER RIDGE PLAZA/TAX INCREMENT DISTRICT #6 PUBLIC HEARING <br />UNTIL APRIL 23, 1985. <br /> <br />I <br /> <br />4 Ayes - 0 Nayes, Motion Carried <br /> <br />Council Business <br /> <br />Kelley reviewed the staff report concerning an amendment to <br />Ordinance Section 20-3, Noise Prohibited, and noted that <br />Glen Baron, Blue Bell Ice Cream, was present to answer any <br />questions. <br /> <br />(Councilmember Bob Benke arrived at 8:23 p.m.) <br /> <br />Motion by Harcus, seconded by Janecek. to WAIVE THE READING <br />AND HOLD THE FIRST READING OF AN ORDINANCE AMENDING CHAPTER <br />20, SECTION 20-3, NOISE PROHIBITED, OF THE NEW BRIGHTON <br />CITY CODE. <br /> <br />Schmidt asked Baron if he had experienced any safety prob- <br />lems in cities where Blue Bell Ice Cream is operating with <br />the bell-ringing. <br /> <br />I <br /> <br />Baron indicated there have been no accidents; his firm <br />works with the Chief of Police/Safety Director in each city <br />to determine hazardous areas which Blue Bell would then not <br />work. <br /> <br />Janecek expressed a desire to have children enjoy the "ice <br />cream man" in their neighborhoods. <br /> <br />Benke questioned the amplification of the bells; Baron re- <br />sponded by amplification would be less than 65 decibels. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Page Five <br /> <br />Council Business <br /> <br />Ordinance Amendment <br />- Noise Prohibit- <br />ed; Chapter 20, <br />Section 20-3 <br />Report 85-79 <br />
