<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Minutes <br />April 10, 1984 <br /> <br />imprudent for the Commission to approve the revised <br />plan without having a consultant review it. <br /> <br />Thursday, April 5th, at the Commission's meeting, it <br />was stated that Group W couldn't market what was in <br />the amendment until a consulting firm gave their <br />recommendations and it was voted to hire a consultant <br />for $30,000 to be paid for by Group W. <br /> <br />Schmidt expressed concern that if Group W started <br />marketing, each city could be brought to court because <br />they fund the budget, and that now the Commission <br />doesn't have a revised plan because of the action that <br />was taken which controverted the action taken last <br />March. <br /> <br />One city, with one vote, somehow diverted staff from <br />the action that had been taken at the March meeting <br />and, without being on the agenda, to go in a completely <br />different direction and putting the Commission on the <br />hook for legal fees to the extent that Group W would <br />try to market it. <br /> <br />Benke stated that we went into this with nine other <br />suburbs in good faith with the assumption that people <br />would work together and, based on the last meeting, <br />some should be reminded that the group can do without <br />some of the cities. <br /> <br />Schmidt stated that the Commission's attorney needs to <br />know that he services at the will of the commission <br />and he jeopardizes his position as a staff person if <br />he does not serve as directed by a majority of the <br />Commission, and the minority cities should not be <br />allowed to divert the action of the majority. <br /> <br />Motion by Benke, seconded by Harcus, to APPROVE A <br />RESOLUTION SUPPORTING THE AMENDMENT TO THE FRANCHISE <br />ORDINANCE, FAVORING AUTHORIZATION TO GROUP W TO <br />COMMENCE MARKETING, AND REFUSING TO CONTRIBUTE FUNDS <br />FOR LEGAL EXPENSES, NOT INCURRED BY THE NORTH SUBURBAN <br />CABLE COMMISSION, INCURRED ON BEHALF OF CITIES WITH <br />A MINORITY POSITION ON THE COMMISSION. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Announcements and Updates <br /> <br />Schmidt stated he would send letters commending <br />Winkels, Sue Franke of the New Brighton Chamber of <br />Commerce, and Mike Buckley of Group W for the video <br />produced for the City of New Brighton. <br /> <br />Benke noticed that several things were left out and <br />Schmidt mentioned it would be redone this summer for <br />the Star City Program. <br /> <br />Page Eleven <br />
