<br />I <br /> <br />I <br /> <br />I <br /> <br />Councilmember Schmidt stated that he can remember <br />being a part of a committee of the Planning Commission <br />a few years back when the standards and analysis for <br />the 1-3 District were prepared. Councilmember Schmi~t <br />-stated he felt the new ordinance just adopted regard1ng <br />industrial districting was very good and that he believed <br />the City should proceed with the rezoning as proposed_ <br /> <br />Councilmember Benke stated that he felt the 1-3 District <br />provided flexibility to the Council in terms of uses <br />that could be permitted yet at the same time provided <br />some control in recognition of this property's location <br />adjacent to a park, lake and residences boardering that <br />lake. <br /> <br />j <br /> <br />Mr. Rolph Worden, attorney representing Walburn Ltd. <br />and Texgas, was present and stated that Walburn and <br />Texgas were opposed to the rezoning. <br /> <br />Mr. Bill Chapman, representing Mr. Richard Bury, <br />was present to review his impact study regarding <br />the Walburn Ltd. site of which Mr. Bury is a <br />partner. Mr_ Chapman reviewed the history of the <br />property noting that the property in question and <br />surrounding properties had been used for many years <br />for industrial uses and that these uses will be <br />continuing for the next several years. Mr. Chapman <br />stated that the Mid~est Asphalt plant is an important <br />industry that provides important products and <br />employment opportunities. ~r. Chapman stated that <br />Midwest Asphalt would be adversely impacted by <br />the rezoning as it ~ould be made a non-conforming <br />use and therefore could not expand or enlarge its <br />operation. Mr. Chapman stated that the property <br />is ideal for industrial uses as it has rail availability <br />and good transportation access to Highway 96 and <br />the interstate system. Mr. Chapman further noted <br />that there is nothing ih the Metropolitan Council <br />guidelines requiring or specifically referring to <br />rezoning of this property and that Ramsey County <br />also has no objection to the current zoning of the <br />property. <br /> <br />Counci lrnember Schmidt asked 1-!r. Chapman if he were <br />a~are that the City ~as proposing that the property <br />re~ain in an industrial classification. <br /> <br />:.:r. Chapman stated tr.at he \,'a5 aware the proposed <br />rezoning would be to a lower industrial classification <br />and he stated that he felt the Council was not prepared <br />to proceed with the rezoning at this time and that it <br />would create a substantial hardship to Nr.
