I' 'ill qualifies for a regular license. The mitil!ation plan may include such steps as: changes in tenant screening procedures. changes in lease terms. security measures. rules and rel!ulations for tenant conduct. and security personnel. The application with a proposed mitigation plan will be presented to the City Council together with a recommendation by the City Manal!er or the Manal!er's desil!nee as to the disposition thereof. After giving the applicant an opportunity to be heard and present evidence. the Council shall approve. disapprove. or approve with conditions the application and the mitil!ation plan. If the Council disapproves an application and mitil!ation plan or approves it with conditions. it shall state its reasons for so doinl! in writinl!. ill The licensee shall comply with the mitil!ation plan as approved or modified bv the Council. No later than the tenth day after each calendar month. the licensee shall mail or deliver to the New Bril!hton Director of Public Safety a written report describing all steps taken in furtherance of the mitilZ:ation plan durinl! the preceding month. Section 14. New Brighton City Code is amended by adding new Section 13-162 as follows: Sec. 13~162. Manaeer certification. ill To Qualify for a provisional license. the applicant must provide and maintain at least one resident manalZ:er or on site manalZ:ers who are on site or available 24 hours a dav and who are certified under this section. ill Persons may be certified as resident or on site manal!ers who successfully complete the training program provided or specified by the New Bril!hton Police Department. ill Licenses may be granted to applicants who are not currentlv providing a certified resident or on site mana~er. and licenses may continue in effect on the departure of a certified resident manager. on the condition that a resident manaller or on site manal!er rel!ister for and complete the traininll prollram as promptly as is reasonably possible. Section 15. New Brighton City Code is amended by adding new Section 13~163 as follows: i i Sec. 13~163. Conduct on licensed premises. ill It shall be the responsibility of the licensee to see that persons occupvinl! the licensed ; premises conduct themselves in such a manner as not to cause the premises to be disorderlv. ' For purposes ofthis Section. a premises is disorderly at which anv ofthe following activities occur: ! A. Violation of Chapter 18 Article III (Narcotics and Drul!s) or violation of laws: relatinl! to the possession of controlled substances as defined in Minnesota Statutes Section i 152.01. Subd.4. B. Violation of Sec. 18-3 (Disorderlv Conduct) or Minnesota Statutes. Section 609.72. C. The unlawful sale ofintoxicatinl! liquor or 3.2 percent malt liquor. D. Violation oflaws relatinl! to l!ambling. E. Violation of laws relatinl! to prostitution as defined in Minnesota Statutes. Section : 609.321. Subd. 9. or acts relating to prostitution. F. Unlawful use or possession of a firearm or weapon in violation of Chapter 18. Article : II. Minnesota Statutes. Section 609.66. Subd. la. 609.67 or 624.713.
