<br />., <br /> <br />, , <br /> <br />rOo <br />I <br />I <br />I <br />I <br />, <br /> <br />ORDINANCE NO. <br /> <br />681 <br /> <br />, ' <br />.. : <br />i: <br />1, I <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />AN ORDINANCE ADOPTING THE STATE FOOD CODE AND <br />AMENDING CITY CODE CHAPTER 10 <br /> <br />'THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON ORDAINS as follows: <br /> <br />Section 1. Section 10 of the New Brighton City Code of Ordinances is repealed in its entirety <br />! .and replaced with the following: <br /> <br />: :Sec. 1 O~ 1. Purpose. <br />tiThe purpose of this Chapter is to establish standards and general objectives for safeguarding the <br />I !public health and general welfare of the people of the City of New Brighton. These general <br />,[objectives include: <br /> <br />!(1) Prevent food-borne illness; <br /> <br />,(2) Correct and prevent conditions that may adversely affect persons utilizing food establishments; I <br /> <br />(3) Provide minimum standards for the design, construction, operation and maintenance of food <br />i :establishments; and <br /> <br />I' <br /> <br />'(4) Meet consumer expectations of the quality and safety of food establishments. <br /> <br />i ISec. 10~2. Scope. <br />: !(1) This Chapter applies to food establishments located in the City of New Brighton such as, but not <br />i :limited to, restaurants, boarding houses, drive-ins, bars, cafeterias, delicatessens, snack bars, <br />i 'convenience stores, caterers, cafes, clubs, lodges, commissaries, lodging facilities, resorts, public and <br />. ,private schools, public buildings, group day care facilities and similar businesses and establishments <br />where food; meals - full and partial; or beverages are prepared or served for consumption on or off <br />I ,the premises. <br /> <br />i <br />1(2) Except where higher standards are established by a city ordinance or a state regulation, food <br />. lestablishments subject to those city ordinances or state regulations shall be required to comply. <br /> <br />Sec. 10~3. Definitions. <br />i :Definitions of words, phrases and terms used in this Chapter shall be those set forth in Minnesota <br />: Rules, Chapter 4626, the City of New Brighton Code, and this Section. <br /> <br />. ,(1) City. The City of New Brighton. <br /> <br />(2) Health Authority. The New Brighton Sanitarian or other designated agent. This ordinance shall <br />,be administered by the Health Authority. The term "regulatory authority" where used in the <br />iMinnesota Food Code, Minnesota Rules Chapter 4626, shall mean the Health Authority. <br />i <br />: I <br />; ISec. 10~4. Standards Adopted. <br />:Minnesota Rules, Parts 4626.0010 through 4626.1870, the Minnesota Food Code, and Parts <br />: 14626.2000 through 4626.2025 are adopted by reference and incorporated into this Chapter. <br /> <br />~ i <br />
