<br />,: Sec. 10~5. License Administration. <br />'i (1) Annual License Required. No person shall operate a food establishment within the corporate <br />: I limits of the City unless a license for the current year has been obtained therefor pursuant to this <br />. Chapter. A license shall not be issued until compliance with this ordinance has been determined by <br />the Health Authority. <br /> <br />, . (2) License Application. Application for licenses shall be made on forms furnished by the City and <br />.. shall set forth the general nature of business, the location, and such other information as is required. <br />The issuance of licenses and their maintenance, termination, and administration shall be in <br />, accordance with and subject to all conditions ofthe City code. <br /> <br />'; (3) Fee Exemption. Food service in or operated by charitable institutions, places of religious <br />. worship, schools, charitable and non-profit hospitals, and itinerant food establishments operated by <br />. a social or service agency shall be required to apply for and obtain a license and shall be subject to <br />all requirements of this Chapter, but shall not be charged a fee therefor. <br /> <br />(4) Display of License. Licenses shall be conspicuously displayed at all times in all licensed food <br />: establishments. All food vehicles shall be identified with a decal, license plate, or other means <br />! supplied by the City displayed in a conspicuous place thereon designated by the City. <br /> <br />I P <br />I <br /> <br />I <br /> <br />1 \ <br />I <br /> <br />;. (5) License Fee. Fees for licenses shall be set by Council resolution. An additional fee may be <br />. charged for each additional service or operation that is separate, distinct or unique from the central <br />, ; or main food establishment, as determined by the City. <br /> <br />(6) License Expiration. Licenses shall expire on the last day of March each year. <br /> <br />'. (7) Food Safety Training. The City may require an applicant for a license to participate in a meeting <br />, or training session for the purpose of providing information on the factors that cause and prevent <br />!: food borne illness. <br /> <br />i i Sec. 10~6. Food Sources. <br />. All food received or used in all food establishments shall be from sources approved by the Health <br />, Authority. All food in all food establishments shall be clean, wholesome, free from spoilage, <br />adulteration, and misbranding, and shall be prepared, processed, handled, packaged, transported and <br />, stored so as to be protected from contamination and spoilage and shall be safe for human <br />consumption. No home prepared foods shall be kept or used in any food establishment except that: <br />(1) Home prepared foods may be used in a building used for religious worship; family day care <br />· ; homes and group family day care homes governed by Minnesota Statutes, Chapter 245A; and <br />nonprofit senior citizen centers for the sale of home-baked goods; and <br /> <br />, (2) Food not prepared at a food establishment that is brought in by members of an organization for <br />consumption by members at a potluck event. <br /> <br />Sec. 10~7. Inspections and Plan Review. <br />. (1) Inspection required. The Health Authority shall inspect each food establishment prior to issuing <br />a license for a new establishment or change of ownership. The Health Authority shall inspect every <br />food establishment as frequently as the Health Authority may deem necessary to insure compliance <br />. with this Chapter, and not less than the minimum inspection frequency as established by Minnesota <br />I I Statutes, Chapter 157 or other applicable statutes or rules. <br /> <br />· (2) Inspection Report. The Health Authority shall deliver an inspection report to the owner, <br />. manager or the employee who appears to be responsible for operations at the time of inspection. In <br />lieu of delivering such a report, the Health Authority shall post it upon an inside wall of the food <br />.: establishment, not in a public area, and such inspection report shall not be defaced or removed by <br />
