'rrhab an application for non-cbnforming use permit(NC-55) <br />was filed with the City of NeW Brighton on January 25,1982. <br /> <br />2. That the planning Commission, pursuant to published and <br />mailed notices, held a public hearing on February 16, 1982, <br />all person I s present at the hearing were given an oppCDr~ ,- <br />tuni ty to be heard. i' <br /> <br />3. That such application was reviewed by the city council on <br />February 25, 1982. <br /> <br />4. The written comments and analysis of the City Staff, the <br />Planning Commission minutes and recommendation were con- <br />sidered. <br /> <br />NOW THEREFORE BE IT RESOLVED, that the New Brighton City <br />Council makes the following Findings of Fact in respect to <br />NC-55: <br /> <br />, ,~ <br /> <br />~ t <br />H <br />~ ; <br />;,' <br />\i <br /> <br />1. That the property is zoned 1-:,2, Heavy Industrial and the <br />Comprehensive Rezoning is pending to 1-3, Limited <br />Industrial: <br />2~. That the City has found this type of use consistent with <br />the 1-3 zoning district through past action: <br />3. That there are the following existing Type IV non- <br />conformities: <br />A. Front yard building setback - 40' required. <br />B. Rear yard building setback - 20' required.' <br />C. Controlled access/driveways (maximum of 2 driveways); <br />D. Concrete curbing along driveways to front building line; <br />E. Lack of front yard landscaping (except area byr:.main <br />entrance). Sod and plantings required for all areas in <br />front yard not used for driving: <br />F. Loading docks within 50 feet of the right-of-way: <br />G. Lack of paving of driving,. rnanuvering and parking areas; <br />H. Handicap parking and accessibility is required; and <br />I.
