<br />(4) Appeal Involving Termination. When a regular or part-time employee receives notice of <br />termination from the city manager, that employee shall be suspended without pay pending <br />notification of appeal as provided in this Section. If the employee does not appeal, the <br />" termination shall become effective upon the expiration of the same period set forth in Section <br />21-18, Step 1. The appeal process shall not be available to probationary, temporary, paid on- <br />call, seasonal, or volunteer employees. <br /> <br /> <br />Sec. 21-19. Demotion. <br /> <br />': <br /> <br />An employee may be demoted for unsatisfactory perfonnance of duties, for disciplinary <br />reasons, or as part of a reorganization plan if it would allow the employee to remain employed <br />by the City in lieu of being laid off. An employee is to be given a written notice five work days <br />before the effective date of demotion. <br /> <br />The notice shall outline reasons for demotion and the employee's rights to appeal the decision to <br />the City Manager. An employee may receive a decrease in pay. It shall be the responsibility of <br />the City Manager to determine the amount of the pay decrease, if any, upon demotion of an <br />employee. <br /> <br />Sec. 21-20. Reclassification. <br /> <br />Upon reclassification, an employee may receive an adjustment in pay commensurate with the <br />employment classification. <br /> <br />Sec. 21.21. Layoff. <br /> <br />(1) Prior to a layoff, the City Manager shall consult with Department Directors to determine <br />which employees shall be laid off. Fitness for the job, job perfonnance evaluations, and <br />, potential shall be the primary determinates in layoffs. Seniority shall be considered when the <br />City Manager determines that all other factors are equal. <br /> <br />(2) The City Manager shall give a minimum of fourteen calendar days notice to any employee <br />to be laid off. The notice shall be written and shall indicate the reasons for the layoff. <br /> <br />(3) An employee may be demoted from a higher class to a lower class at the City Manager's <br />discretion. <br /> <br />, ' <br />
