An employee leaving municipal service in good standing after giving written <br />" notice at least fourteen calendar days prior to the date of resignation shall be compensated for <br />accrued vacation up to 160 hours of vacation leave <br /> <br />Sec. 21-65. Other Leaves of Absence With Pay. <br /> <br />(I) A regular or orientation employee who is required to serve as a juror or who is under <br />subpoena as a witness in court related to City business shall be granted leave with pay while <br />serving in this capacity. Upon completion of jury service, the employee shall remit the jury <br />check to the City less the amount received for travel expenses. <br /> <br />(2) The City Manager may authorize other leaves of absence with pay when in the best interest <br />of the employee and the City. <br /> <br />Sec. 21-66. Unpaid Leave. <br /> <br />(1) A request for leave without pay shall be made in writing to the Department Director and <br />then approved by the City Manager. Approval of leave shall take into account relevant factors <br />including, but not limited to, the following: <br />A. Service needs of the City. <br />B. Perfonnance record ofthe employee. <br />C. Employee's length of service. <br />D. Reason for and circumstances of the request. <br /> <br />(2) A leave of absence shall not exceed a period of ninety calendar days. After conferring with <br />the Department Director, the City Manager may grant an extension if the total unpaid leave does <br />not exceed 180 calendar days except when the employee is detailed for military service or <br />becomes disabled as a result of performing the duties of their job. No vacation, holiday, sick <br />leave, or seniority shall accrue or be paid during a period of leave of absence without pay. <br /> <br />(3) Specific reasons for which an unpaid leave of absence will be considered include, but are not <br />limited to: <br />A. Child care. <br />B. Disability incurred while in the service of the City. <br />C. Military service. <br />D. Death or serious injury in the immediate family. <br /> <br />(4) Upon expiration of the approved leave without pay, the employee shall be reinstated to the <br />former position or a position of like status and pay. Failure of the employee to report for work <br />at the expiration of the leave shall be cause for discharge. <br /> <br />(5) A regular employee shall be entitled to a military leave of absence without pay for services <br />in the armed forces for a required tour of duty as provided for in Minnesota Statutes, Section <br />192.26. Request for unpaid military leave shall be accompanied by a copy of the military orders <br />! and shall be made prior to the commencement of the unpaid leave. <br /> <br />Sec. 21-67. Sick Leave. <br /> <br />(1) Purpose. Sick leave shall not be considered as a privilege or vested right which employees <br />
