<br />Sec. 21-3. Administration. <br /> <br />The City Manager is authorized and directed to administer this Chapter. The City Manager may <br />issue administrative directives and instructions, consistent with this Chapter, as necessary to <br />explain and clarify the provisions and to facilitate their use. The City Manager may designate an <br />assistant to aid in the administration of this Chapter and to perform, under supervision, any <br />other functions which the City Manager is authorized to perform. In exercising these duties, the <br />City Manager may delegate to Department Directors and supervisors the power and duty to act <br />on personnel matters within their respective areas in accordance with the directives, guidelines, <br />I and instructions given. <br /> <br />Sec. 21-4. Positions Covered. <br /> <br />All employees in the municipal service shall be subject to this Chapter, except the following: <br /> <br />(1) Elected Officials, members of Boards and Commissions, volunteer members of the Public <br />Safety Department, consultants and personnel paid on a fee basis, and other persons specifically <br />exempted by the City Council. <br /> <br />(2) No provision of this Chapter is intended to violate, supersede, or conflict with any applicable <br />constitution, statute, or Pederallaw or regulation; any provision of civil service rules; or, a <br />collective bargaining agreement in effect between the City and any of its employees. To the <br />extent of any such conflict or violation, the offending provision of this Chapter shall be void but <br />all remaining provisions of this Chapter shall remain in effect. <br /> <br />Sec. 21-5. DefmitiollS. <br /> <br />Words and phrases used in this Chapter shall be as defined in generally accepted common usage <br />except that the definitions of this Section shall apply when these words and phrases are used in <br />this Chapter. <br /> <br />(1) Accrual of Benefits. The accumulation and increase of vacation and sick leave over a period <br />of time to be used at a later time. <br /> <br />(2) Anniversary Date. The month and day of initial hiring or promotion of an employee. <br /> <br />(3) Applicant. A person seeking a position of employment with the City. <br /> <br />(4) Appointment, Regular. The status of a regular employee upon successful completion of the <br />required orientation period. <br /> <br />(5) Appointment, Orientation. The initial hiring or promotion of an applicant. <br />
