<br />Sec. 21-9. Appointments. <br /> <br />i j <br />!' (1) All appointments and promotions to the municipal service shall be made by the City <br />Manager solely on the basis of qualifications as required by the position relative to experience, <br />training, personal and physical fitness, skills, knowledge, and test results. <br /> <br />(2) Veteran's preference shall be granted to those persons entitled to the same in accordance <br />with Minnesota Statutes, Chapter 197. Proof of military service shall be supplied by the <br />veteran. <br /> <br />(3) It shall be the policy of the City to fill vacancies in the municipal service by promotion <br />whenever practicable with current employees. Promotion opportunities shall be evaluated with <br />due regard to merit, fitness, and ability. The promotion policy shall not be construed as a <br />mechanism to bypass minimum requirements for a position, to avoid requirements, or to <br />discourage lateral entry of more qualified candidates. <br /> <br />(4) The City Manager may make a provisional appointment to any position in order to prevent <br />inconvenience to the public or stoppage of public business. No benefits shall be accrued by <br />provisional appointees unless they are also regular employees of the City in another capacity. <br />Provisional appointments shall be terminated by action of the City Manager. Unless approved <br />by the City Council, provisional appointments shall not remain in force longer than ninety <br />consecutive calendar days. <br /> <br />(5) The City Manager may transfer any employee from one position to another within the same <br />position class. <br /> <br />Sec. 21.10. Orientation Period. <br /> <br />(1) All regular appointments to the municipal service shall be subject to the serving of a <br />" probationary period. The orientation period shall be regarded as an integral part of the initial <br />, selection and examination process and shall be utilized for: closely observing the employee's <br />'; work, securing the most effective adjustment of the employee to the position, and rejecting any <br />employee whose performance does not meet the required work standards of the class. <br /> <br />(2) Except for Public Safety Officers, the orientation period for all City employees shall be six <br />months from the date of employment or promotion. <br /> <br />(3) The orientation period for all Public Safety Officers shall be one year from the date of <br />employment or promotion. <br /> <br />(4) Iffound to be unsuited for the position to which an employee has been promoted or <br />transferred, the employee may be reinstated to the position and rate of payor other position in <br />the class from which they were promoted or transferred, if such position has an opening, subject <br />to approval of the City Manager. <br /> <br />(5) An employee during hislher orientation period may be discharged from their position at any <br />time during the orientation period by the City Manager. Successful completion of the <br />orientation period does not in and of itself create any entitlement to continued employment. <br />Employment remains at will. <br />
