<br />(d) Each application shall be accompanied by an inspection fee as established by City Council <br />resolution, payable to the City for each such bench. <br /> <br />(e) Ifthe application is approved an additional permit fee will be required in the amount as <br />specified by City Council resolution, payable to the City of New Brighton for each such bench <br />at the time the permit is issued. <br /> <br />(f) All permits shall expire as of December 31 following the date of issuance thereof unless <br />renewed. Upon renewal, a renewal fee shall be required to be paid in an amount specified by <br />City Council resolution, payable when the application for renewal is filed. Renewal of penn its <br />shall not be automatic. One factor in considering a permit renewal will be the level of <br />demonstrated demand by the public for the courtesy bench. <br /> <br />(g) Application for renewal shall be made in such form as the City Manager shall require and shall <br />be submitted prior to the expiration date ofthe preceding permit. Renewal permits may be <br />issued without further proof of consent ofthe owner(s) of the land or lessee(s) of the property <br />upon which such bench is located on or adjacent to unless written objection to such renewal of <br />penn it shall have been previously filed by the owner(s) or lessee(s). The City Manager is <br />authorized to approve permit renewals. <br /> <br />(h) Whenever a bench for which a permit has been issued is sold or title control thereof transferred <br />or assigned, a new permit shall be required. <br /> <br />(i) One application may be made by the owner of several benches at different locations, but a <br />separate number and permit shall be assigned and issued for each bench authorized to be <br />installed and each such permit shall be valid only for the particular location designated therein <br /> <br />Sec. 25-123. WHERE COURTESY BENCHES ARE PROHIBITED. <br /> <br />No permit shall be issued for the installation of any such bench: <br /> <br />(a) at any location which in the judgement ofthe City Manager would interfere with the use of the <br />street or sidewalk and any alley or driveway, or impair vision at intersections or crosswalks. <br /> <br />(b) at any location less than 30 feet or more than 50 feet from the nearest point of intersection at the <br />curb face with a street or within 20 feet of a fire hydrant. The City Council may waive this <br />requirement, or make necessary adjustments, based on a hardship caused by unique or unusual <br />circumstance pertaining to the physical character of the bench site or street intersection. <br /> <br />(c) at any location between the curb face of a street and an existing public sidewalk, providing, <br />however, that when, in the opinion of the City Council, observance ofthis requirement would <br />result in inconvenience or hardship, the City Council may waive such requirement. <br /> <br />(d) In locations where a public sidewalk is not present, courtesy benches shall be installed parallel <br />with the curb and set back not less than 60 inches from the face of the curb. <br /> <br />Sec. 25-124. DENIAL OR REVOCATION OF PERMITS. <br /> <br />(a) New or renewal applications may be denied by the City Manager if, in the exercise of the <br />Manager's discretion, there is not a sufficient need therefor to justify placement of a bench in <br />light of the visual clutter, hazards, or inconvenience caused thereby. The application shall be <br />denied ifthe City Manager finds that the bench would tend unduly to obstruct passage along any <br />public sidewalk or public right of way, or to create a hazard, or otherwise to be detrimental to <br />the public safety, convenience or welfare. <br />
