<br />(b) If the owner(s) or lessee(s) of any surrounding property shall by writing filed with the City <br />Manager on or before the first day of January preceding the expiration of any permit, withdraw <br />his or her consent to a bench requiring his consent, the City Manager shall promptly notifY the <br />permittee of the filing of such writing and shall deny the renewal of such permit. <br /> <br />(c) An applicant may appeal the decision of the City Manager denying, revoking, or declining to <br />renew a permit or attaching conditions or restrictions to a permit, to the City Council by <br />requesting a hearing thereon, in writing, within ten (10) days ofreceipt ofthe Manager's <br />decision. <br /> <br />(d) Failure to comply with any section ofthis Article is a misdemeanor and ground for <br />revocation of the permit. <br /> <br />Sec.25-125. INSTALLATION AND MAINTENANCE OF BENCHES. <br /> <br />(a) No bench shall be more than thirty (30) inches deep, forty two (42) inches high, or eighty four <br />(84) inches long over all. <br /> <br />(b) Each bench shall have displayed thereon, in a conspicuous place, the permit number as provided <br />by the City. <br /> <br />(c) It shall be the duty of the permittee to maintain each bench at all times in a safe condition at its <br />proper location and to inspect each bench periodical1y in order that it be properly maintained. <br />Benches shall be installed on a level and stable base, preferably on a concrete slab. <br /> <br />(d) Any graffiti shall be removed from any courtesy bench within two days of receipt of notice by <br />the City. <br /> <br />(e) Snow shall be removed from the bench and surrounding area within five (5) days of any <br />snowfall of two (2) inches or more which assures adequate access for use and maintenance. <br /> <br />(f) Weeds and grass shall be maintained at less than 12 inches in length. <br /> <br />Sec. 25-126. ADVERTISING AND SIGNS. <br /> <br />(a) No advertising matter or sign shall be displayed upon any bench except upon the front and rear <br />surfaces of the backrest. The sign space shall be confined to no more than 12 square feet on the <br />front side and 12 square feet on the backside of the backrest. <br /> <br />(b) No advertising matter or sign on any bench shall display the words "Stop", "Look", "Drive-in", <br />"Danger", or any other word, phrase or symbol which might impede the safe flow of traffic. <br /> <br />(c) No advertising matter or sign on any bench shall display, promote, or sell tobacco products or <br />alcoholic beverages. <br /> <br />Sec. 25-127 . REMOVAL OF BENCHES. <br /> <br />(a) Upon revocation or expiration of any permit without renewal, the permittee shall promptly <br />remove the bench and supporting structure and restore the site to its original condition. If the <br />permittee fails promptly to remove a bench, the City Manager may do so within ten (10) days <br />after written notice given by mail directed to the address of the permittee on file, and if the <br />permittee shall fail to pay the costs of removal and restoration thereof within a period of sixty <br />(60) days after the giving of such notice, the pennittee's right in said bench shall be forfeited, <br />but such forfeiture shall not excuse the permittee from the payment of costs for removal and <br />restoration of said bench area. <br />
