<br />"," <br /> <br />~ <br /> <br />.:. .... <br /> <br />/ If" ) <br /> <br />. <br />\- <br /> <br />ORDINANCE NO. 623 <br /> <br />AN ORDINANCE FOR PROTECTING THE PLANNING <br />PROCESS AND THE HEALTH, SAFETY AND WELFARE OF <br />THE RESIDENTS OF THE CITY, PLACING A MORATORIUM <br />ON NEW DEVELOPMENT IN CERTAIN AREAS OF THE <br />CITY OF NEW BRIGHTON ALONG THE OLD HIGHWAY 8 <br />CORRIDOR. <br /> <br />THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON ORDAINS AS FOLLOWS: <br /> <br />Section 1. Background. <br /> <br />1.01. In 1987 the City Council accepted the New Brighton Highway Eight Corridor Plan, <br />prepared by Gair and Associates, as a resource document to identify vacant or underutilized <br />properties which were available or could be made available for appropriate development or <br />redevelopment, and to direct such future development and redevelopment. <br /> <br />1.02. Since 1987 many properties in the study area of the Highway Eight Corridor Plan <br />have been developed or redeveloped. The Plan has not been updated since 1987. <br /> <br />1.03. Minnesota Statutes, Section 473.864, subd. 2 requires the city to review and, if <br />necessary, amend its comprehensive plan and official controls by December 31, 1998. <br /> <br />1.04. The city's comprehensive plan has not been updated since 1990. <br /> <br />1.05. As required by law the city will be reviewing, updating and amending its <br />comprehensive plan and official controls. <br /> <br />1.06. The city council has determined that certain areas of the City along the Old <br />Highway Eight Corridor are vacant or underutilized, suffer from inefficient lot layout, are <br />significantly contaminated, or are occupied by nonconforming uses. Additionally, certain <br />properties in the city are used or zoned for uses which are not compatible with use or zoning of <br />adjacent or nearby properties, or which may not be compatible with the zoning of adjacent or <br />nearby properties after the city has reviewed and amended its comprehensive plan and official <br />controls. <br /> <br />1.07. The city council has determined that certain areas affected by this ordinance suffer <br />from inefficient or hazardous trafTic circulation, and the council has under consideration a number <br />of changes or extensions of public roads in the vicinity of the Old IIighway Eight Corridor which <br />are not consistent with the current comprehensive plan or oHicial controls. <br /> <br />1.08. In connection with consideration of an application for a special use permit and other <br />development proposals in the area af1ected by this ordinance, the city council has reviewed the <br />existing and potential development in the area.
