Properties adjacent to and on the <br />west side of Old Highway 8 between County Road E and 6th Street NW; and properties bounded <br />by 1 st Street NW on the south, Old Highway 8 on the west and north, and the MT Properties, <br />Inc. (formerly Minnesota Belt Line RY) railroad right-of-way on the east. <br /> <br />2.06. Highway 8 North Commercial Industrial Area. Property bounded by Old Highway <br />8 on the east, Long Lake Park on the north and west and 1-694 on the south. <br /> <br />2.07. Railroad Site. Property bounded by 1st Street NW on the north, the MT Properties, <br />Inc. (formerly Minnesota Belt Line RY) railroad right-of-way on the south, 8th Avenue NW on <br />the west, and the extended east line of 5th Avenue NW on the east. <br /> <br />2.08. USF Holland Site. Property bounded by 1st Street NW on the south, the MT <br />Properties, Inc. (formerly Minnesota Belt Line RY) railroad right-of-way on the west and north <br />and the property located at 348 1st Street SW on the east. <br /> <br />Section 3. Prohibition. <br /> <br />3.01. Except as provided in Section 4, during the period this interim ordinance is in <br />effect, no properties subject to the moratorium may be developed, or redeveloped and no site plan <br />approvals, rezonings, licenses (other than renewals), plattings or replattings, land divisions or <br />consolidations, special use permits, or building permits will be considered, approved or granted <br />by the city. <br /> <br />Section 4. Exception. <br /> <br />4.01. This ordinance shall not apply to: <br /> <br />a) developments or redevelopments which have secured all necessary <br />approvals other than building permits; <br /> <br />b) issuance of building permits for projects which do not require site plan <br />approval pursuant to New Brighton City Code, Section 8-010; or <br /> <br />c) final plat or subdivision approval which have received preliminary plat <br />approval prior to the effective date of this ordinance, providcd all conditions of <br />preliminary plat approval have been satisfied. <br /> <br />Section 5. Effect on Pending Applications. <br /> <br />5.01. All applications subject to this moratorium which are pending or which arc received <br />during the time this ordinance is in effect shall be deemed to be denied for purposes of Minnesota <br />Statues, Section 15.99. The City Manager shall cause notification of such denial to be given to <br />all applicants stating the adoption of this ordinance as the reason therefor.
