That an application for variance, VN-216 was filed <br />with the City of New Brighton on August 14, 1980. <br />2. That such application was reviewed by the New Brighton <br />Planning Commission Board of Review on August 19, <br />1980 and September 16, 1980. <br />3. That the City Council, pursuant to published and <br />mailed notices, held a public hearing on October 14, <br />1980, all person1s present at the hearing were given <br />an opportunity to be heard. <br />4. The written comments and analysis of the City staff, <br />the Planning Commission minutes and recommendations <br />were considered. <br /> <br />NOH THEREFORE BE IT RESOLVED, That the New Brighton <br />City Council makes the fOllowing Findings of Fact in respect <br />to V N - 2 16: <br /> <br />1. That the property is zoned 1-2, Heavy Industrial; <br />2. That the design for the proposal denotes customer <br />and employee parking on the east and west sides <br />of the building with large commercial vehicular <br />parking between the buildings to be screened <br />from surrounding residential properties and the <br />public right-of-way; <br />3. That the front yard parking is approximately 100 <br />feet from the public right-of-way; <br />4. That the property. isunjque in that County Ditch #2 <br />a designate,dflood plain is situated' on the <br />eastern portion of the site prohibiting construction <br />of structures in that area. <br />5. That the property i~ uni~~~ in that it ~as an <br />irregular shape with limited ~ccess to the <br />public right-of-way. <br /> <br />BE trf='URTHER RESoLvED, That the application VN-216 <br />is and hereby approved subject to the following conditions: <br /> <br />1. That the six parking spaces denoted on the site plan <br />north of building A be removed; <br />2. That the landscaping east of the ,firiont.:pa'rkirig,lot be <br />well maintained and the landscaping east of the <br />driveway on County Road IIEII be revised to include <br />additional planting~ to provide screening of the <br />parking from the pUblic right-of-way; and <br />3. The approval of PUD-2 and LP-106. <br />
