<br /> r' <br /> 'I ~ ~ <br />- ~ I <br />~ <br /> <br />RESOLUTION NO 2291 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br />FOR NON-CONFORMING USE PERMIT, NC-43 <br /> <br />WHEREAS, An application for a non-conforming use permit <br />entitled NC-43 has been made by Sinclair Marketing Inc, to <br />permit the reopening of a vacant gasoline service station <br />with existing Type IV non-conformities; and <br /> <br />WHEREAS, The procedural history of the application is <br />as follows: <br /> <br />1. That an application for non-conforming use permit, <br />NC-43 was filed with the City of New Brighton on <br />November 6, 1979, <br /> <br />2. That such application was reviewed by the New <br />Brighton Planning Commission Board of Review on <br />November 20, 1979, <br /> <br />3, That the City Council, pursuant to published and <br />mailed notices, held a public hearing on November 27, <br />December 11, 1979 and January 8, 1980, all person's <br />present at the hearing were given an opportunity <br />to be heard. <br /> <br />4. The written comments and analysis of the City staff, <br />the Planning Commission minutes and recommendations <br />were considered. <br /> <br />NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br />Council makes the following Findings of Fact in respect to <br />NC-43: <br /> <br />1, That the site is zoned B-3, General Business, <br /> <br />2, That the site has the following existing Type IV <br />non-conformities: <br /> <br />A. Lack of the required 30 feet of landscaping <br />in the front yard of the site. <br />B, lack of the required concrete curbing enclosing <br />all driving and parking areas, <br /> <br />3, That the applicant proposes to undertake the <br />following in order to address the existing Type IV <br />non-conformities: <br /> <br />A, The installation of concrete curbing along all <br />driving and parking areas, <br />B. Provides landscaping around the perimeter of <br />the site. <br /> <br />4, That the applicant does not propose to create any <br />additional non-conformities; and <br /> <br />5, That this proposal meets the intentions of Section <br />3-60 of the zoning code by eliminating one non- <br />conformity (lack of concrete curbing) and reducing <br />the extent and impact of the other non-conformity, <br />the lack of landscaping in the front yard. <br /> <br />11, <br />I' <br />'I <br />I ' <br />
