<br />-. <br /> <br />. <br /> <br />. <br /> <br />Section 31. Section 4-112 is hereby amended to read as follows: <br /> <br />Sec. 4-112. License fees. <br /> <br />(1) The annual license fee for ttft "on-sale" and "off-sale" liquor license~ <br />shall be set by council resolution:. and "On-sale" liQuor licenses shall be <br />categorized as follows: <br /> <br />(a) Small restaurants. <br />(b) Medium restaurants. <br />(c) Large restaurants. <br />(d) Hotels and motels. <br />(e) Clubs. <br />(f) Exterior public area. <br /> <br />(2) The annual license fee shall be paid in full before the application for <br />a license is accepted. All fees shall be paid into the general fund of the <br />city. Upon rejection of any application for a license, or upon withdrawal of <br />application before approval of the issuance by the city council, the license <br />fee shall be refunded to the applicant. <br /> <br />(3) The fee for an "on-sale!" "off-sale" or "on-sale club" license granted <br />after the commencement of the license year shall be prorated on a daily <br />basis. <br /> <br />(4) When the license is for a premises where the building is not ready for <br />occupancy, the time fixed for computation of the license fee for the initial <br />license period shall be ninety (90) days after approval of the license by the <br />city council or upon the date the building is ready for occupancy, whichever <br />is sooner. <br /> <br />(5) No part of the fee paid for any license issued under this division shall <br />be refunded except in the following instances upon application to the council <br />within thirty (30) days from the happening of the event. The council may in <br />its judgment refund a pro rata portion of the fee for the unexpired period of <br />the license, computed on a monthly basis, when operation of the licensed <br />business ceases not less than one month before expiration of the license <br />because of: <br /> <br />(a) Destruction or damage of the licensed premises by fire or <br />other catastrophe. <br /> <br />(b) The lieeRsec's illftes3. Any reason other than license <br />revocation which makes the business unlawful. <br /> <br />(c) The licensee's death. <br /> <br />9 <br />
