<br />,./ <br /> <br />'" . <br /> <br />SECTION 9.70 Elections. <br /> <br />SLlbd. 1. Elected positions on the Department shall be <br />by a majority vote in a secret ballot. The election to be <br />held annually at 8 PM during the November meeting. There <br />shall be no absentee ballots nor voting by proxy. The <br />results of such election shall be reviewed by the Manager <br />who shall approve or reject such results. If the Manager <br />rejects the election results or should an officer position <br />be vacant, the Chief shall order another election to be held <br />for that position. The Chief shall set a date and time for <br />that election within not less that thirty (30) days, and no <br />more than ninty (90) days. <br /> <br />.- <br /> <br />Subd. 2. Apprentice firefighters, members on <br />suspension, and members on leave of absence are not eligible <br />to hold an elected position. <br /> <br />Subd. 3. Members on medical leave of absence for a <br />period exceeding nint~ (90) consecutive days are not <br />eligible to hold an elected position. This provision may be <br />waived upon a majority vote of the Department. <br /> <br />SECTION 9.71 Expulsion, Penalties, and <br />Resignations. A Member is subject to demotion, suspension <br />or expulsion for violation of the provisions of these <br />articles. The Department shall, upon a majority vote, <br />provide a statement of charges and recommendations of <br />discipline to the Manager when disciplinary action appears <br />necessary. The Manager may discipline any Member of the <br />Department by means of a suspension or demotion, or ma~ <br />dismiss a Member from the Department with or without the <br />recommendation of the Department. <br /> <br />SC:CTION 9.72 Leave!'", of absence. A member may appl~ <br />in writing for a leave of absence} including a leave of <br />absence for medical reasons} for a specified period not to <br />exceed one (1) year. The application shall set forth the <br />beginning and ending dates of the requested leave, the <br />reasons therefor} and the statement that the member intends <br />to return to service with the department at the end of the <br />leave period. During the leave period, the member will not <br />be deemed to be an active member of the department and will <br />not be subject to requirements relating to attendance at <br />fires, emergencies} meetings or drills. The approval of an <br />application shall be voted on by the members of the <br />department at a regular monthly meeting, or as soon as is <br />reasonably convenient. If the membership of the department, <br />by a majority of the members voting, approves the <br />application, it shall be submitted to the city manager. The <br />city manager shall grant the leave of absence if, in his or <br />her Judgment, after considering the reco~mendation of the <br />chief, the needs of the city and the department will not be <br />adversely affected thereby. The membership of the <br />department by a majority vote, the chief or the city manager <br />may require verification of medical conditions claimed as <br />the basis for a medical leave of absence by a designated <br />licensed physician. A le~ve of absence, including a leave <br />of absence for medical reasons, shall not be deemed a period <br />of active service as a member of the department and shall <br />not be included in computing sevice time. <br /> <br />SECTION 9.73 Compensation. All Members of the <br />Deaprtment shall be paid an amount established by resolution <br />of the City Council. <br /> <br />SECTION 9.74 Retirement. All Members must retire from <br />active service at age sixty (60). Upon majority vote of the <br />Members and approval of the Manager, retirement may be <br />extended on a year-to-year basis, but not beyond age sixty- <br />five (65). Any Member so extended may be required to give <br />evidence that such Member is capable of performing all Job <br />requirements and meets all minimum job requirements. <br /> <br />6. <br />
