.' 5 bb. wholesome shall mean food which is sound, healthful, C1C:l~ unadulterated, and in all ways fit for human consurrption. SECTION 10-3. Applicability of Ordinance. a. No person shall operate or engage in the business of operating a food establishment within the City of New Brighton except in conformance with this Food Code whether a license is required or not. b. The provisions of this ordinance shall apply to the construction, operation and maintenance of vending machines, vehicles which are food establishments, and food vehicles except as they are clearly incapable of application to vending machines, vehicles which are food establishments, and food vehicles or where they are inconsistent or in conflict with provisions of this ordinance which are specifically related to vending machines and food vehicles. SECTION 10-4. Licenses. a. Limi tatioo on Number of Licenses . In cases where individual food establishments have, on a single premises, multiple food handling activities of types listed in this Food Sanitation Code as requiring licenses, only one license shall have to be obtained, unless otherwise specified in this Food Sanitation Code, and that license shall be for the principal activity, as determined by the health authority, conducted in the food establishment. This provision shall not relieve any individual, firm or corporation of the necessity of acquiring such other licenses as other sections of the City Code may require. b. Food Establishment License. No person shall operate or engage in the business of operating a food establishment within the corporate limits of the City of New Brighton unless a license shall have been obtained therefore from the City Council. Licensees of food vehicles shall also be required to obtain, for the premises on which the food carried in the food vehicles is stored, handled or processed, a Food Establishment License or Packaged Food Establishment License, determined according to the standard of paragraph a, of this Section, in addition to a Food Vehicle License or Food Vehicle Fleet License, if such premises are located within the City of New Brighton . c. Food Vehicle License. No person shall operate or engage in the business of operating a food vehicle within the corporate limits of the City of New Brighton unless a license shall have been obtained therefore from the City Council. Neither a transient merchant license nor an itinerant food establishment license, shall be required in addi ticn to a Food Vehicle License of Food Vehicle- Fleet License.
