'Ihe City shall give the COIT?any reasonable notice of plans to grade, regrade or change the line of any street or public place or to con- st:ruct or reoonstnlct any public utility system therein. Subd. 2. 'Ihe Corrpany shall be required to relocate its facilities at its 0NJ1 expense \mere grade changes are made by the City for inproved drainage or irrproved traffic conditions, provided, ho.'/- ever, if a subsequent relocation or relocations shall be ordered because of a grade change \qithin ten (10) years from and after the first relocation, the City shall reirrburse the Cqr!lpany for such non- bettement relocation ~nse wnich the Conpany rlay incur on a tirre and material basis. If subsequent relocations are required because of the extel"".sion of public utilities to previously unserved areas, the CoITpany nay be required to relocate at its am expense at any t..i.rre. Subd. 3. Any relocation, rerroval, or arrangerrent of any CarpmlY facilities rra.de necessary because of the extension into or through the City of a federally aided high\vay project shall be governed by the provisions of Hinnesota Statutes Section 161. 46 as supplerrented or arre.'1dedi and further it is eXpressly understood that the right herein granted to the CCT.1pany is a valuable property right and the city shall not order the company to rem:we or relocate its facilities without cO~J1sation \"hen a street or public way is vacated, -,,-improved .or realigned because of a '.rene\'lal'or a-redeveloprrent plan \'I.'hiC:.'1 is financially subsidized in all or in part by the federal governrrent or a.'1Y agency thereof, unless the reasonable non-betterrrent costs of such relocation and the 1055 and expense resulting therefrom are first paid to the CaTpa.'1y.
