'Ihe Corrpany shall be required to relocate its <br />facilities at its 0NJ1 expense \mere grade changes are made by the City <br />for inproved drainage or irrproved traffic conditions, provided, ho.'/- <br />ever, if a subsequent relocation or relocations shall be ordered <br />because of a grade change \qithin ten (10) years from and after the <br />first relocation, the City shall reirrburse the Cqr!lpany for such non- <br />bettement relocation ~nse wnich the Conpany rlay incur on a tirre <br />and material basis. If subsequent relocations are required because of <br />the extel"".sion of public utilities to previously unserved areas, the <br />CoITpany nay be required to relocate at its am expense at any t..i.rre. <br /> <br />Subd. 3. Any relocation, rerroval, or arrangerrent of any <br />CarpmlY facilities rra.de necessary because of the extension into or <br />through the City of a federally aided high\vay project shall be <br />governed by the provisions of Hinnesota Statutes Section 161. 46 as <br />supplerrented or arre.'1dedi and further it is eXpressly understood that <br />the right herein granted to the CCT.1pany is a valuable property right <br />and the city shall not order the company to rem:we or relocate its <br />facilities without cO~J1sation \"hen a street or public way is vacated, <br />-,,-improved .or realigned because of a '.rene\'lal'or a-redeveloprrent plan \'I.'hiC:.'1 <br />is financially subsidized in all or in part by the federal governrrent <br />or a.'1Y agency thereof, unless the reasonable non-betterrrent costs of <br />such relocation and the 1055 and expense resulting therefrom are first <br />paid to the CaTpa.'1y. <br /> <br />Subd. 4.
