The City shall give the Co;;pany reasonable written <br />notice of plans for street i..Irproverrents where paving or resurfacing or <br />a pcr11'ill1ent nature is involved, ,.;hich notice shall contain the nature <br />and character of the inproverrents, the streets upon ,.;hich the i.rrprov.::;:rrf-~t.~ <br />are to be m3.de, the extent of the inproverrents and ~c ti.rre ",'hen the City <br />anticipates that it or its contractor is going to start the work and, if <br />rrore than one street is involved, the order in ,,-him this ,..ork is to <br />proceed. Paving or resurfacing of a permment nature refers only to <br />portland Cerrent concrete or hic;h type hi tu.'1linous. <br /> <br />Subd. 2. The notice shall be given to the Corrpany a sufficient <br />length of ti.rre, considering seasonable working cordi tions, in advance of <br />the actual ccrnrencerrent of the ,..ark to ~rmi. t the Cortpany to make any <br />additions, alterations or'repairs to its facilities deerred necessary by <br />it and the COmpany assurres full responsibility for liability associated <br />with its rraintenance and repair activities. <br /> <br />J <br /> <br />SOOd. 3. In cases where streets are at final width and grade, <br />the city has installed underground public utility mains and service <br />connections to the property line abutting the streets prior to a pennanent <br />paving or resurfacing of such streets, and the Corrpany' 5 train is located <br />under such paved surface of the street, the Cortpany shall be required to <br />install gas service connecticns and reasoncble train e:x:tensions prior to <br />such paving or resurfacing, \'inenever it can reasonably be expected that <br />gas service ",ill be required during the five years follcwing the paving <br />or resurfacing. <br /> <br />Subd. 4. Once notice has been given by the City to the Ccrrpany <br />in accord with this section, the City may m::dify its plans. '!he Con"i?c-"l....",y <br />shall make reasonable inquiry to ascertain the status of previoUSly <br />armounced City plans. <br /> <br />SOCTICN 9. IDeation of Facilities. <br /> <br />Subd. L All mains, serviCEs, goverr:.ors and other property and <br />facilities shall be so located, constructed, installro ar.d rraintained as <br />not to endanger or unnecessarily interfere \'lith the usual and custonury <br />trade, traffic, travel upon an.d use of the streets ar.d public places of <br />the city.
