Non-Conformity--Eminent Domain. Where the <br />taking under eminent domain of a portion of the land upon which <br />there existed a lawful use of the land or a structure thereon prio <br />to such taking, results in such use becoming unlawfUl under the <br />Zoning Code, such use is a non-conforming use and may be continued <br />under the provisions of this chapter. <br /> <br />SECTION 3-80. Repairs and Maintenance. Repair and 'main- <br />tenance work may be permitted by the building inspector on buildin s <br />included in Type II and Type IV non-conformities so long as the <br />cost does not exceed 50% of the current assessor's market value fo <br />such building and so long as such work does not involve repair or <br />replacement of the foundation or bearing walls. Where the cost 0 <br />such work exceeds 50% of the current assessor's market value for <br />such permission for such work must be obtained from the City Counc'l <br />pursuant to Section 3-60 in the case of a Type IV non-conformity <br />, and the non-conforming status of the building shall terminate as <br />I to a Type II non-conformity. <br /> <br />I SECTION 3-90. Transition Zoninq (Lots in Two Districts) <br />II Where a district bo~ndary li~e.as established in this ordinance or <br />il as shown on the zon~ng map d~v~des an unplatted lot or unplatted <br />!~rcel of land which wag in single ownership and of record on <br />i August 13, 1974, the use thereon and the other district require- <br />I; ments applying to the least restricted portion of such lot under <br />! the Zoning Code shall be considered as extending to the entire lot, <br />if the more restricted portion of such lot is entirely within 50 <br />feet of subdividing district boundary lines. Any use <br />for which a special use permit or variance has been issued as <br />provided in the Zoning Code shall not be deemed a non-conforming <br />use, but shall without further action be deemed a conforming use <br />in such district. <br /> <br />SECTION 3-110. Essential Services. Unsafe Struc'\Zures. Nothing in this chapter <br />shall prevent the temporary strengthening or restoring to a safe <br />condition any portion of a,puilding or structure declared unsafe <br />by the City Building Inspector. <br />
