Such permission may be granted only <br />after a public hearing and shall requ,ire a 4/5 <br />vote of the entire city Council. The procedure <br />(not conditions) shall be the same as that for a <br />variance. The application fee shall be fifty(50) <br />dollars. The City Council may require plans or <br />other evidence regarding the present and proposed <br />use. <br /> <br />f. <br /> <br />Whenever any such use is superseded by a permitte <br />usei the non-conforming status of the premises <br />shall terminate. <br /> <br />SECTION 3-50. <br /> <br />Requlations as to Type III Non-Conformities. <br /> <br />SECTION 3-60. <br /> <br />I' <br /> <br />Requlations as to Type IV Non-Conformities. <br /> <br />a. <br /> <br />Where Type IV non-conformities are present and <br />are proposed to continue, expansion of existing <br />structures, construction of new structures, or <br />resumption of use after discontinuance of use for <br />six or more months shall be allowed only upon <br />permission of the City Council. Such permission <br />may be granted only after a public hearing and sh <br />require a 4/5 vote of the entire City Council. <br />The procedure (not conditions) shall be the same <br />as that for a variance.
