It shall be unlawful <br />for any person to own, keep, have in his possession, or harbor an <br />dog which, by frequent and habitual howling,5Jelping, barking, or <br />otherwise shall cause serious annoyance or disturbance to persons <br />or to the neighborhood, provided that the provisions of this <br />ordinance shall not apply to duly authorized hospitals or clinics <br />, conducted for the treatment of small animals. No person shall be <br />convicted under the provisions of this ordinance except upon <br />evidence of two or more adult persons, each of a different house- <br />hold, and no warrant shall be issued except after five (5) days <br />written notice has been mailed or delivered to the occupant of the <br />premises where such dog is kept or harbored, advising that a <br />complaint has been made about the dog and, calling attention to the <br />provisions of this section of the code. <br /> <br />Section 630:26. Bitinq, Quarantine. Whenever any dog or <br />animal has bitten any person, the owner or custodian of such dog <br />or animal having been soxnotified by the New Brighton Police shall <br />immediately cause the dog or animal to be quarantined at the New <br />Brighton Dog Pound for a period of ten (10) days after such person <br />has been bitten by said dog or animal. During the quarantine <br />period, said dog or animal shall be kept under observation to dete _ <br />mine its condition and if it is found to be sick or diseased, the <br />operator of the quarantine facility shall immediately report in <br />writing to the New Brighton Police the condition of the dog or <br />animal. During the quarantine period, the dog or animal shall not <br />be removed from the designated quarantine facility except by speci I <br />writtenocpermit from the Minnesota Livestock Sanitary Board and the <br />New Brighton Police. The owner of said dog or animal shall be <br />responsible for the cost of such quarantine. The quarantine <br />required by this section shall not be necessary and the require- <br />mentsshall be waived whenever the owner or custodian of such dog <br />or animal, immediately upon receipt of the notice referred to <br />above, presents to the Nciw Brighton Police the certificate of an <br />authorized veterinarian that the dog or animal was vaccinated for <br />rabies on a date less than one yaar prior to the date of such <br />notice. . <br /> <br />I Section 630:28. Muzzlinq.Proclamation. Whenever the <br />prevalence of hY9.rophobia renders such action necessary, to protec <br />the public health and safety, the mayor shall iSsue a proclamation <br />ordering every person owning or keeping a dog to confine it secure <br />on his premises unless it is muzzled so that it cannot bite.
