In the repair, addition or change Of any undergrou <br />!i facilities within highways and streets no person or company shall <br />iibe permitted to interfere with the underground facilities of any <br />I other person or company, except so far as shall be necessary to <br />lmake such repairs, additions or changes. All such repairs, additi s <br />or changes shall be made in accordance with specifications as <br />approved by the City Engineer' and the city Engineer shall be <br />lnotified before work thereon is commenced, except that the city <br />!Engineer at his discretion, may waive such conditions for emergenc <br />III street opening and for repair. <br /> <br />,I Section 412: 06 Existinq Electric Service to Electric <br />!lutilitv Customers. <br /> <br />II subd. 1. Whenever Sectiol1 412: 02 requires an electr ic <br />)utility to replace overhead facilities with underground facilities, <br />II all customers of the utility receiving electric service from the <br />'overhead lines to be removed must take appropriate action to <br />!rewire their existing service to accept underground service from <br />'lthe utility prior to the removal of overhead lines. <br /> <br />I Subd. 2. The electric utility shall upon notification from <br />,the city that an overhead line must be replaced pursuant to <br />Ise~tion 412:02, notify its ~ffected customers ,at,least 60 days <br />lpr~or to the proposed start~ng date of constr1ict~on that the <br />lutility is required by this ordinance to replace overhead facilitie <br />l'supplying electricity to his building: that on or about a certain <br />date such overhead facilities will be removed: that if he desires <br />Ito continue receiving electric service he must execute the <br />llutilities applicable unde, rgr6und,ag, reement form when requested by <br />lthe utility and conVert or adapt l'hiselectrical facilities at his <br />hexpense to accept the new underground service. Any failure by the <br />ll'utility to ~r~vide such notice t~ every affected, customer, or any <br />jalleged def~cl.ency of such a notl.C€!f shall not be deemed a breach <br />Ilof this ordinance or to create any liability on the part of the <br />l!utility to its customers, or in any manner affect the requirement <br />llthat said electrical facilities be installed underground. <br />i <br />! Subd. 3. After any particular segment of an electric utilit 's <br />llfacilities are installed underground, the city shall determine the <br />,!date by which the overhead facilities being replaced thereby shall <br />i1be removed by the utility.
