iJ <br /> <br /> <br /> <br /> <br /> RESOLUTION No. <br /> 07-044 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEw BRIGHTON <br /> RESOLD ON MAKING FINDINGS OF FACT AND APPROVAL OF A SITE PLAN, PLANNED UNIT <br /> DEVEL MENT AND SPECIAL USE PERMIT. <br /> WHERE , an application has been made by Kraus Anderson to be considered for Site Plan, <br /> Planne Unit Development, and Special Use Permit applications to allow construction of three <br /> retail b ildings, a 43,000 s.f. fitness center, a 14, 400 s.f. retail building, and a 11,000 s.f. retail <br /> buildi , and associated joint use surface parking and access. <br /> <br /> WHERE , the procedural history of the application is as follows: <br /> 1. Ap ications for a Site Plan Review, Planned Unit Development, and Special Use Permit <br /> we received on March 30, 2007, however were considered incomplete. <br /> 2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br /> on pril 17, 2007 and all present were given a chance to freely speak at the hearing. <br /> 3. The Planning Commission continued the public hearing to a Special Meeting to be held on <br /> M 1, 2007. <br /> 4. The applications for a Site Plan, Planned Unit Development, and Special Use Permit were <br /> de ed complete on April 25, 2007. <br /> 5. A blic hearing notice was again published in the New Brighton Bulletin on April 25, 2007. <br /> 6. A notice of public hearing was mailed to all property owners within 600' on April 20, 2007. <br /> 7. The Planning Commission re-opened the public hearing where all parties present were given <br /> the pportunity to speak at a special meeting held on May 1, 2007. <br /> 8. The Planning Commission recommended conditional approval on May 1, 2007. <br /> 9. The City Council considered the request on May 8, 2007. <br /> WHERE, the Planning Commission and City Council make the following Findings of Fact in <br /> respec o PUD2007-002, LP2007-002 and SP2007-002: <br /> 1. Th property is located at 2303 Palmer Drive and is legally described as follows: <br /> Tr aft D except that part described as follows: Commencing at the Northwest corner of said <br /> Tr 4o D, thence Southerly along the West line of said Tract D, a distance of 258.10 feet; <br /> th ce at right angles Easterly a distance of 190 feet; thence Northerly and parallel to said <br /> W t line of said Tract D to the North line of said Tract D; thence West along the North lime <br /> of aid Tract D to the point of beginning, in Registered Land Survey No. 237, files of <br /> Re 'stray of Titles, County of Ramsey. <br /> 2. Th property is zoned B-3, General Business District. <br /> 3. Th property is guided in the Comprehensive Plan for Community Business. <br /> 4. Th total property area is approximately 7.8 acres. <br /> 5. Th Planning Commission and City Council recommend approval for a Site Plan review in <br /> accordance with Zoning Ordinance Section 8-010, subject to conditions. <br /> 6.
