<br />. <br /> .. . .... <br />'" <br />, <br />, RESOLUTION NO. 1585 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT, DENYING APPLICATION FOR SPECIJ~ <br /> USE PERMIT SP-6l, DENYING APPLICATION FOR VARIANCE VN-140 AND <br /> STATING REASONS FOR SUCH DENIALS <br /> WHEREas Dahlke Trailer Sales, Inc. has made application <br /> to the City for a Special Use Permit to allow the operation of a <br /> sales and leasing office, garage and parking area for semi- <br /> trailers, and <br /> WHEREAS Dahlke Trailer Sales, Inc. has also made <br /> application to the City for a variance to permit a 25 foot <br /> setback from the north property line for parking and maneuvering, <br /> and further, to permit a six foot high chain link fence in lieu <br /> of concrete cur9ing at the edge of such parking area along the , <br /> street side yard along 5th Street N.W., and <br /> WHEREAS such applications have been duly processed by <br /> the City staff, reviewed by the Planning Commission, and <br /> considered by the City Council at a properly called public <br /> hear ing thereon , <br /> : <br /> ! <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton City: <br /> Council hereby makes the following findings of fact in respect to <br /> SP-61 and VN-140: i <br /> , <br /> Findings of Fact <br /> 1. The application for special use permit SP-6l was <br /> filed wi.th the City on J,une 5, 1975, and the <br /> application for variance VN-140 was filed'with the <br /> City On June 5,1975. <br /> 2. The applications met the tec:hnical requirements for <br /> consideration by the City Council. <br /> 3. The Planning Commission considered the special use <br /> permit application on June 17, 1975, and recommended <br /> approval thereof on certain conditions. <br /> 4. The Planning Commission considered the variance <br /> application on June 17, 1975 and July 15, 1975, <br /> and recommended approval thereof on certain conditions <br /> 5. The City Council, pursuant to published and mailed <br /> notices, held a public hearing on July 22, 1975, to <br /> consider the applications. All persons present, <br /> including the applicant, its architect, its attorney! <br />i and corporate officers, were given an opportunity <br />I <br />, to be fully heard, and a petition, containing 45 <br /> signatures, in opposition to the application was <br /> received. <br />
