<br />.... <br />" "'" , <br /> .. <br />1, ., ~ ), <br />~ 2074 <br /> RESOLUTION NO. <br />~ <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING NON- <br /> CONFORMING USE PERMIT NC~31. <br /> WHEREAS, an application for a non-conforming use permit <br /> NC-3l has been made by, Beisswenger's New Brighton Hardware <br /> to permit the expansion of a building located at 1360 Old <br /> Highway #8, and <br /> WHEREAS, the procedural history of the application is as <br /> follows: <br /> 1. That an application for non-conforming use permit <br /> NC-31 was filed with the City on July l3, 1978. <br /> 2. That the Board of Review heard and reviewed the <br /> application at its meeting of July 3l, 1978. <br /> 3. That the City Council pursuant to published and <br /> mailed notice, held a public hearing on August 8, <br /> 1978 to consider the application. All person 's <br /> present at the public hearing were given an <br /> opportunity to be heard. <br /> 4. The written comments and analysis of the City <br /> Planner, the Planning Commission minutes and <br /> recommendations made at the Public Hearing were <br /> considered. <br /> NOW THEREFORE BE IT RESOLVED by the Council of the City <br /> of New Brighton that the following findings of fact are <br /> made in respect to NC-31; ... <br /> 1. That the followlng non-conformltles eXlst on the property <br /> at l360 Old Highway 8: landscaping. (Current <br /> . a. Lack of front yard <br /> regulations require the entire front yard <br /> to be landscaped and not used for parking). <br /> b. Lack of a dustless driving and parking surface. <br /> c. Lack of concrete curbing along driveways. <br /> d. parking of vehicles in the front yard. <br /> e. Less than required front yard setback. <br /> f. Less than required l5 foot side yard setback. <br /> g. parking within 15 feet of a street right-of-w~y. <br /> h. Inadequate wall treatment on street side of <br /> structure. <br /> 2. That site and landscape plans submitted indicate <br /> tha t the following improvements would be made <br /> relative to the existing non-conformities: <br /> a. Concrete curbing will be provided adjacent to <br /> landscaped areas. <br /> b. Front yard parking would be reduced. <br /> c. Front yard landscaping is shown to be <br /> substantially increased. <br /> d. The primary parking areas will have asphalt <br /> paving. <br />
