<br />.. <br /> ,. \ <br />,~ I <br />.. <br />- <br /> RESOLUTION NO. 2025 <br />I <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING NON-CONFORMING <br /> USE PERMIT, NC-23. <br /> WHEREAS, an application for a non-conforming use permit <br /> NC-23 has been made by Q Petroleum Corporation to permit the <br /> re-use of property having Type IV non-conformities, located <br /> at 2190 Silver Lake Road, and <br /> WHEREAS, the procedural history of the application is as <br /> follows: <br /> l. That an application for non-conforming use permit <br /> NC-23 was filed with the City on February 20, 1978. <br /> 2. That the Board of Review heard and reviewed the <br /> application at its meeting of March 21, 1978. <br /> 3. That the City Council, pursuant to published and <br /> mailed notices, held a public hearing on March 28, <br /> 1978, to consider the application. All persons <br /> present at the hearing were given an opportunity to <br /> be heard. <br /> 4. The written comments and analysis of the City Planner, <br /> the Planning Commission minutes and recommendation, <br /> and all person's statements made at the public hearing <br /> were considered. <br /> NOW THEREFORE BE IT RESOLVED by the Council of the City <br /> of New Brighton that the following findings of fact are made <br /> in respect to NC-23: <br /> 1. That the following Type IV non-conformities exist on <br /> the property: <br /> A. Less than required front yard landscaping. A 30 <br /> foot landscaped front yard is required. <br /> B. Less than required side street yard landscaping. <br /> A 15 foot landscaped strip is required adjacent to <br /> Mississippi Street. <br />~.~..... Off-street parking within 30 foot front yard setback. <br /> C. <br /> area. <br />
