RESOLUTION No. 10-013 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON MAKING FINDINGS OF FACT AND APPROVAL OF A SPECIAL USE PERMIT. ✓HER s, an application has been made by Rob Viera on behalf of Clearwire Communications to allow placement of a 70' light pole with a 100' light pole, including installation of three panel anten s, three microwave dishes, and a ground utility cabinet at Freedom Park, 2121 14th Street NW, d 'HERs, the procedural history of the application is as follows: 1. A application for a Special Use Permit was received on October 30, 2009. 2. T Planning Commission, pursuant to published and mailed notices, held a public hearing on qovember 17, 2009 and all present were given a chance to freely speak at the hearing. 3. Tft applicant held a neighborhood meeting at Freedom Park on Thursday, November 12, 2019. 4. T Planning Commission recommended the City Council approve the request on November 17 009. 5. Tapplicant was notified in writing on December 11, 2009 that the City would be ej�c ising their right to take an additional 60 days to review the request. 6. TCity Council considered the request on January 26, 2010. ✓HERE , the Planning Commission and City Council makes the following Findings of Fact with respec o the Special Use Permit (SP2009-010): 1. Th. property is zoned R-1, Single Family Residential. 2. T property is guided in the Comprehensive Plan for Park. 3. Th applicant has proposed to construct at 100' pole, to replace the existing 70' pole, in 1 ding installation of three panel antennas, three microwave dishes, an at grade utility ca net, and remounted of the ball field lights at 70' at Freedom Park, 2121 14`" Street NW. 4. Th proposal also includes a 10' x 20' lease area to support the ground equipment, which is roul My the size of a small refrigerator. 5. Th Planning Commission and City Council determined those criteria of Section 4-600 (2 & 4) e met. 7. Th Planning Commission and City Council reviewed the proposal in accordance with the fol wing additional Special Use Permit standards of Zoning Code Section 8-130: a. hat the establishment, maintenance, or operations of the special use will not be etrimental to or endanger the public health, safety, morals, comfort or general welfare. b. Fhat the special use will not be injurious to the use and enjoyment of other property in he immediate vicinity for the purposes already permitted, nor substantially diminish and mpair property values within the neighborhood.
