RESOLUTION NO. <br />10-034. <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVAL OF A NONCONFORMING USE PERMIT. <br />s, an application has been made Bethel College to permit demolition of a detached <br />structure, thereby reducing the amount of covered parking at 691-799 151 AVE NW, <br />and <br />%HE AS, the procedural history of the application is as follows: <br />1. application for a Nonconforming Use Permit was received on April 9, 2010. <br />2. a Planning Commission, pursuant to a mailed notice to property owners within 350', held <br />ublic hearing on May 18, 2010 and all present were given a chance to freely speak at the <br />3.jTe Planning Commission recommended approval on May 18, 2010 subject to conditions. <br />4. e City Council considered the request on May 25, 2010. <br />iHEI EAS, the Planning Commission and City Council make the following Findings of Fact with <br />resp t to the Nonconforming Use Permit (NC2010-002): <br />1. e property is zoned R -3A, High Density Residential. <br />2. e property is guided in the Comprehensive Plan for High Density Residential. <br />3. a applicant would like to remove the northerly detached garage structure, eliminating 19 <br />vered parking stalls, and re -striping surface stalls. <br />4.e applicant maintains the garage is in need of removal so as to increase surface parking, <br />crease on -street parking, and to increase safety and security issues on site. <br />5. a garage demolition will provide for a net increase of 17 surface parking stalls on site. <br />6. a existing nonconformities are as follows: <br />Fewer off-street parking stalls than required by code. <br />Fewer covered parking stalls than required by code. <br />Front, side, and rear yard parking lot setbacks less than required by code. <br />7. a Planning Commission and City Council considered the proposed Nonconforming Use <br />rmit in accordance with Zoning Code Section 8-460, which identifies Type 4 <br />nconformities, and allows them to continue when one or more of the following criteria <br />met: <br />a. The total number of nonconformities is reduced. <br />b. The impact of any nonconformity upon adjacent premises is reduced to the greatest <br />practical extent. <br />c The extent of any nonconformity is reduced where practical. <br />8.
