<br />I, <br /> <br />RESOLUTION No. 98-113 <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVAL OF PUD-7. <br /> <br />WHEREAS, an application for a Planned Unit Development has been made by Pratt Ordway <br />Properties and the City of New Brighton; and <br /> <br />WHEREAS, the procedural history of the application for a nonconforming use penn it is as <br />follows: <br />1. <br /> <br />2. <br /> <br />An application for a PUD was filed with the City of New Brighton on November 25, <br />1998. <br />The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on December 15, 1998, and all persons present at the hearing were given an <br />opportunity to be heard. <br /> <br />Now, TIIEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />respect to PUD~ 7, Phase 1: <br /> <br />1. The subject site is zoned 1-1, Light Industrial and 1-2, Heavy Industrial. <br />2. The PUD-7 site is roughly 7 acres in size. <br />3. The subject site is also identified as the Brighton Corporate Park III site, part of a large <br />industrial park which the City began redeveloping in 1988. <br />4. The existing surrounding land uses include single family residential to the north and <br />east and industrial to the west and south. <br />5. The proposed PUD is consistent with the City's Comprehensive Plan which states the <br />subject site should be developed with limited industrial or neighborhood business uses. <br />6. The building and site design for proposed PUD-7 would be compatible with and <br />compliment surrounding land uses. <br />7. The proposed site plan conforms to all of the City's Performance Standards as <br />demonstrated within the Staff Report dated December 22, 1998. <br />8. Trail connections are provided around the perimeter of the site as well as internally. <br />9. Landscaping of the site will tie in to the overall landscaping plan proposed in the <br />streetscape of 5th Avenue NW. <br />10. Sewer and water are available to the site. <br />11. There may be some noise and lighting concerns associated with the convenience <br />gasoline station and car wash. <br /> <br />BE IT FURTHER RESOLVED, the City Council of the City of New Brighton hereby approves PUD- <br />7, subject to the following conditions: <br /> <br />1. Subject to approval of a Zoning Ordinance amendment that allows flexibility in the <br />perimeter setback requirement for PUD's, the building setbacks may be decreased to 8 <br />feet as proposed, subject to the construction of the proposed streetscape plan dated 11- <br />25-98. <br />2. Perimeter curbing be installed around the off-street parking area. <br />3. All off-street parking and drive areas be paved with bituminous surface. <br />4. Off-street parking stalls must be striped with white or yellow painted lines, not less <br />
