<br /> <br />Public Safety Commission <br />January 25, 2016 <br /> <br /> <br />Attending: Commissioner Allen, Commissioner Anderson, Commissioner Boyd, <br />Commissioner Eichers, Commissioner Hollimon, Commissioner Kerns, <br />Commissioner Lamp, Commissioner Schumann, Director Jacobson, Sgt. <br />Emerson, Council Member Strub, and Dave Matteson (Allina Health) <br /> <br />Absent: Commissioner Donohue <br /> <br /> <br />Call to Order/Roll Call <br /> <br />Commissioner Allen called the January meeting to order at 6:30 pm and roll call was taken. <br /> <br />December Meeting Minutes <br /> <br />The December meeting minutes were reviewed. Commissioner Lamp made a motion to approve <br />the December meeting minutes; Commissioner Hollimon seconded. Motion carried. <br /> <br />Public Hearing/Presentation <br />A. Police Use of Force Overview – Sgt. Emerson <br /> <br />Sgt. Emerson defined use of force and the criteria which are used to determine when force may <br />be used. He referenced Minnesota Criminal Code and NBDPS General Order 1. Four <br />circumstances when use of force is authorized include: 1. In effecting a lawful arrest; 2. In the <br />execution of legal process; 3. In enforcing an order of the court; and 4. In executing any other <br />duty imposed upon the public officer by law. <br /> <br />Sgt. Emerson reviewed the State statute on Use of Deadly Force and noted four deadly force <br />circumstances. Sgt. Emerson reviewed use of non-lethal weapons such as strangle holds or the <br />use of a baton/flashlight/gun as a club to strike a person’s head. He also reviewed the use of <br />ASR and Taser. <br /> <br />Sgt. Emerson explained circumstances which justify the use of deadly force and the liabilities <br />attached to the use of force. Sgt. Emerson reviewed the Use of Force Continuum which is part of <br />our General Orders. <br /> <br />Sgt. Emerson explained and demonstrated the use of verbalization and command presence skills <br />used in potential use of force incidents. Any deadly use of force incident would be investigated <br />by an outside agency; we would request the Bureau of Criminal Apprehension (BCA) to do the <br />investigation. <br /> <br />Updates <br />A.
