<br />'! <br /> <br />~ <br /> <br />'I <br /> <br />RESOLUTION NO. _~6~11~_ <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING SPECIAL USE <br />PERMIT~ SP-136. <br /> <br />WHEREAS~ an application for special use permit~ SP-136 has <br />been made by LNR Properties to remove the old Erickson Super Valu <br />building (from hereon referred to as the LNR Properties building) <br />from the Rice Creek Center Sign Plan; and <br /> <br />WHEREAS~ the procedural history of the application is as <br />follows: <br /> <br />1. That an application for special use permit~ SP-136 was <br />filed with the City of New Brighton on October 31~ 1986. <br /> <br />2. That the New Brighton Planning Commission~ pursuant to <br />published and mailed notices~ held a public hearing on <br />November 18~ 1986. <br /> <br />3. That such application was reviewed by the New Brighton <br />City Council on November 25~ 1986. <br /> <br />4. The written comments and analysis of the City staff~ the <br />Planning Commission minutes and recommendations were <br />considered. <br /> <br />NOW THEREFORE BE IT RESOLVED~ that the New Brighton City <br />Council makes the follOWing Findings of Fact in respect to <br />SP-136: <br /> <br />1. That on September 13~ 1977~ the City Council approved <br />8~~2!~~!2~_~2~_!22~ declaring Rice Creek Shopping Center <br />to be an Area of Special Control for purposes of sign <br />regulation. <br /> <br />2. That on November 9~ 1977~ the City Council amended <br />8~!2!~t!2~_~2~_!~~2 by including the old Erickson~s <br />Super Valu building in the Area of Special Control <br />(Resolution 1958). <br /> <br />3. That on December 27~ 1977~ the City Council approved a <br />special use permit (SP-78> adopting the sign plan for <br />Rice Creek Shopping Center~ 2050-2170 Silver Lake Road~ <br />which included the old Super Valu building. <br /> <br />4. That the old Super Valu building at 2170 Silver Lake <br />Road~ from hereon known as the LNR Properties building~ <br />is a shopping center within the meaning 0% the term as <br />defined in Section 9-150 a.2.~ and <br /> <br />5. That the New Brighton Zoning Code states that shopping <br />centers may be designated as areas of special control <br />for purposes of sign regulation~ and ~~!~!~t!~~_~~~_____ <br />designates the LNR Properties building as an area of <br />special control~ and <br /> <br />6. That the New Brighton Zoning Code states that in areas <br />of special control~ the City Council may establish <br />special sign regulations by special use permit. <br /> <br />7. That in the spring of 1986~ the old Super Valu building <br />was purchased by LNR properties and a neW mansard roof <br />and brick facade were constructed around the building~ <br />causing it to appear aesthetically different from the <br />Rice Creek Shopping Center. <br />
