RESOLUTION NO. <br />07-021 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />V MAKING FINDINGS OF FACT AND APPROVING A PLANNED UNIT DEVELOPMENT AMENDMENT <br />-001). <br />'HEREA an application has been made by David Bernard Builders and Developers (the "Applicant") to <br />be con ered for an amendment to the previously approved PUD, PUD2006-002, to allow far inclusion <br />of deck to the SS+ and New Urban Flat condominium buildings by the City Planning Commission and <br />tE ,the procedural history of the application is as follows: <br />1. he original Planned Unit Development (PUD2006-002) was approved by the City Council on <br />ugust 22, 2006 for the entire west side of Old Highway 8 NW within the Northwest Quadrant, <br />ow known as Long Lake Landings. <br />2. application for a Planned Unit Development Amendment was filed with the City of New <br />righton on March 2, 2007. <br />3. ublic hearing notices for the proposed Planned Unit development were published in the New <br />righton Bulletin on March 7, 2007. <br />4. he Planning Commission, pursuant to published and mailed notice, held a public hearing on <br />arch 20, 2007 and voted to approve the request. <br />S. he City Council reviewed the request on March 27, 2007 and voted tp approve the request in <br />ccordance with the Planning Commission recommendation. <br />WHE S, the Planning Commission and City Council make the following Findings of Fact with respect <br />to the ed Unit Development Amendment (PUD2007-001): <br />1. he Planning Commission previously recommended approval of the Long Lake Landings <br />Tanned Unit Development on August 15, 2006. <br />2. he City Council subsequently approved the Long Lake Landings Planned Unit Development, <br />ocumented in Resolution 06-085. <br />3 <br />4. <br />ection 7-220 (2) (C) (2) establishes the following final PUD submission requirements: <br />a. If a subdivision is part of the proposed planned unit development, all data required <br />for a final plat according to Chapter 26 of the City Code. <br />b. A fmal plan containing all information required for a building permit in Section 8- <br />O 10 of the Zoning Code. <br />c. A copy of all deed restrictions, covenants to be recorded as part of the planned unit <br />development, and provisions for maintenance, ownership, and preservation of any <br />and all common open space. <br />d. If the planned unit development is proposed to be built in stages, the staging shall be <br />described, including the applicant's best available information regarding location of <br />stage areas and beginning and ending times for each stage. <br />~ection 7-240 establishes the following criteria for Planning Commission and City Council <br />action on a Planned Unit Development: <br />a. The consistency of the proposed development with the adopted or proposed <br />comprehensive plan for the City. <br />
